ALLEGATION(S): Day-care child sustained injuries while in care. INVESTIGATION FINDINGS: On 01/09/2023, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an unannounced inspection and met with Director, Jennifer Silva. Purpose of the inspection was explained, and it was to report the investigations finding for above allegations. Complaint was received by the Department on 11/14/22. Present in the facility are Director and seven staff caring for a total 11 infant children. LPA and Director inspected the facility for health and safety hazards. During the course of the investigation, interviews were conducted with staff and parents, and pertinent documents were received. Based on evidence received, LPA cannot determine if a day care child sustained injuries while in care. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are closed as UNSUBSTANTIATED. After today’s visit, an exit interview was conducted with Director, Jennifer Silva. A copy of this report was reviewed and provided to Director. Upon receipt of this report, Facility shall post the Notice of Site Visit. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain postings as required, will result in an immediate $100 civil penalty. This report is public and can be reviewed. Unsubstantiated Estimated Days of Completion:
(1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as the facility tested after the deadline of January 1st, 2023. This posed a potential health, safety or personal rights risk to persons in care.
