Personal Rights: (a)The licensee shall ensure that each child is accorded the following personal rights:(2): To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: Based on interviews and record review, Staff did not meet C1's diapering needs which resulted in a diaper rash, which poses a potential health, safety or personal rights risk to persons in care.
ALLEGATION(S): 1. Unqualified teachers supervising children 2. Children are left unattended in classrooms 3. Facility is out of ratio INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Anna Morales conducted an Unannounced Subsequent inspection to deliver the findings for the above allegations. LPA was greeted by Assistant Director Leah Jefferson. On 7/17/24, at 9:13am, an initial complaint investigation was conducted by Licensing Program Analyst (LPA) Farida Raja. Based on LPA Raja's observation and reviewing supporting documentation, the facility was operating in compliance with teacher to children ratio requirement and the teachers had the qualifications to supervise the children. LPA Raja observed in#4(DP), there were 17 Preschool children with 3 staff (One qualified, one teacher's assistant and one teacher's aide), and in Classroom #5, LPA observed 12 children with two staff ( one qualified teacher and one aide). ALLEGATION(S): 1. Staff did not provide a comfortable temperature for daycare children INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) conducted a subsequent visit to deliver the findings for the above allegation. LPA met with Director Marcella Tarin. Based on LPA's observation on several occasions on, 5/12/23, 5/16/23 and on 5/24/23 , LPA observed staff from a roofing company working on the roof. LPA was informed by District Leader Jennifer Liu and Director Marcella Tarin that the sections of the center's roof had been damaged due to the recent rain storm and water had entered inside some of the walls inside the center during the evening of May 8, 2023. Buildings and Grounds, 101238(a)(1)The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. 1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. This was not met by: LPA's observed coackroaches in the patio of the preschool playground, and inside classroom 4,which poses a potential risk to the health and safety of children in care.
101239.2 Drinking Water(a) Drinking water from a noncontaminating fixture or container shall be readily available both indoors and in the outdoor activity area. Based on Assistant Directors Admission, on 6/20/22, approximately at 3:24pm not all of the children had water readily available during outdoor activity , which poses potential Health and Safety risk to persons in care.

Supervision shall include visual observation. This requirement was not met as evidenced by: Staff(S1) left 10 children unattended in the playground on 3/7/25. This is a zero tolerance violation. This poses an immediate risk to the health, safety, and personal rights to children in care.

This requirement was not met as evidenced by: A staff (S1) served oranges to a child (C1) who has known citrus allergy. This posed an immediate risk to the health, safety, and personal rights to children in care.
(1) Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above for S1, S2, S3, which poses a potential health, safety or personal rights risk to persons in care.
1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section above for S1, S2 and S3, which poses a potential health, safety or personal rights risk to persons in care.
(a) The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above for S2, which poses a potential health, safety or personal rights risk to persons in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above, Mandated Reporter Training expired for, S1(expired 8/26/21) and S2(expired 12/27/2021), which poses/posed a potential health, safety or personal rights risk to persons in care.

This poses an immediate risk to the health, safety, and personal rights to children in care.

Supervision shall include visual observation. This requirement was not met as evidenced by: A child was left unattended inside the Infant Playground on June 7,2023. The gate to that separates the infant and toddler playground was left unlocked. This is a zero tolerance violation. This poses an immediate risk to the health, safety, and personal rights to children in care.
Admission Procedures and Parental and Authorized Representative's Rights :In accordance with the child care center's individual program, policies and needs, the licensee shall develop, implement and maintain an admission procedure that enables the person in charge of admissions to: Conduct one or more personal interviews with the child's parent or authorized representative that meets the following requirements:Provides the child's parent or authorized representative with information about the child care center that shall at least include the child care center's admission policies and procedures, activities, services, regulations, hours and days of operation, fees, procedures to be followed should the child become ill or injured while at the child care center, and procedures for conducting inspections for illness. This requirement was not met as evidenced by: P1 has requested a Care Conference with the Center since 2/23 and the Center has yet to comply with P1's request.
Child Care Center Directors Qualifications and Duties:101215.1(f)When the child care center director is absent from the center, arrangements shall be made for a fully qualified teacher as specified in Section 101216.1(c) to act as substitute. This substitute child care center director shall be aware of center operations, including total enrollment; shall be trained in program operation; and shall be designated as an authorized person to correct operational deficiencies that constitute immediate threats to children's health and safety. This was not met by: On May 15, 2023, Staff who were present did not have the code to unlock the door and enter the preschool, which poses a potential risk to the health and safety of children in care.
Reporting Requirements 101212(b):The name of the child care center director, and any fully qualified teacher(s) designated to act in the child care center director's absence, shall be reported to the Department within 10 days of a change of child care center director or designee(s). This was not met by: The child care director whose last day was on 2/24/23 was not reported to Community Care Licensing within 10 days of a change, which poses a potential risk to the health and safety of children in care.
