ALLEGATION(S): Day care did not follow admission agreement INVESTIGATION FINDINGS: On November 18, 2025, at approximately 11:25am, Licensing Program Analyst (LPA) Maria Olguin-Leon conducted an unannounced visit to deliver complaint findings for the above allegations. Original complaint was filed under the wrong facility #414004662. LPA met with the Director M.W. and explained the purpose of the visit. Present during today’s visit were Director, 2 staff caring for 11 preschool children. Facility is operating within capacity. During the course of the investigation, interviews were conducted, observations were made, and pertinent documentation were reviewed. Based on evidence obtained, it was determined that the allegation, Day care did not follow admission agreement, to be UNSUBSTANTIATED. Although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore, the above allegation is UNSUBSTANTIATED. Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain postings as required will result in an immediate $100 civil penalty. ALLEGATION(S): Teacher shoved a child and child fell to ground. INVESTIGATION FINDINGS: On January 8, 2025, at approximately 9:40 am, Licensing Program Analyst (LPA) Maria Olguin-Leon and Licensing Program Manager (LPM) Daniel Oquendo conducted an unannounced inspection and met with Director, Y.N. Purpose of the inspection was explained and was to deliver complaint findings for the above allegation. Present in the facility were Director, 3 staff caring for a total of 15 preschool children. Facility is operating within capacity. During today's inspection, LPA, LPM and Director inspected the facility for health and safety hazards. During the course of the investigation, LPA inspected facility, conducted interviews, conducted observations, and reviewed pertinent documentation provided. Based on evidence obtained, it was determined that the allegation, Teacher shoved a child and child fell to ground, is determined to be UNSUBSTANTIATED. Although the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. Upon receipt of this report, Facility shall post the Notice of Site Visit for 30 consecutive days. Failure to maintain posting as required will result in an immediate $100 civil penalty. 101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal right (1) To be accorded dignity in his/her personal relationships with staff and other persons.This requirement was not met as evidenced by: Based on interviews, a child has been left in soiled cloth for a period of time as it was known to staff. Staff did with hold food from child until child ate their vegetables. Staff member did raise their voice at a child. Lastly, staff told child that they will have to go to the infant classroom since child was misbehaving. This is a potential risk to children in care.
