Section 101429(a)(2)(B) - Staff shall physically check on sleeping infant(s) every 15 minutes & document. This requirement was not met as evidenced by: During record review, LPA Uribe found that staff have not been meeting the requirement for documenting 15-minute checks on sleeping infants which poses a potential risk to the health, safety, or personal rights to children in care.

(b) Each record shall contain information including, but not limited to, the following: (8) Medical assessment, including ambulatory status as specified in Section 101220, and the following health information: (C) A signed consent form for emergency medical treatment unless the child's authorized representative has signed the statement specified in Section 101220(f). This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above as children's files did not have a signed LIC 627 Consent for Medical Treatment form. The facility has an in-house form that is similar but does not have the same statement as the LIC 627 which poses/posed a potential health, safety or personal rights risk to persons in care.
(1) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. Under no circumstances shall ANY infant be left unattended. This requirement is not met as evidenced by: Based on interviews, the licensee did not comply with the section cited above as 2 staff members stated an infant was left unattended in the outdoor play area on the morning of 08/22/2024, which poses an immediate health, safety or personal rights risk to persons in care.
(C) An infant shall not be swaddled while in care. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above as 1 infant (under 12 months of age) was sleeping with a sleep sack on during nap time. which poses/posed a potential health, safety or personal rights risk to persons in care.
(b) There shall be a ratio of one teacher for every four infants in attendance. This requirement is not met as evidenced by: Based on observation and record review, the licensee did not comply with the section cited above as 0 of the 3 staff members present during today's inspection is a fully qualified infant teacher, thus the facility is out-of-ratio, which poses/posed a potential health, safety or personal rights risk to persons in care.
(B) Staff shall physically check on sleeping infant(s) every 15 minutes and document the following: This requirement is not met as evidenced by: Based on observation and record review, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care. LPA observe that facility did not have the 15 minute check log, Director stated that facility visually check the children, but did not know that it needed to be logged on paper.
(r) Fixtures, furniture, and equipment that have been banned or recalled by the United States Consumer Product Safety Commission shall not be used or on the facility’s premises. This requirement is not met as evidenced by: Based on LPA observation, the licensee did not comply with the section cited above. LPA observed an infant bouncer and inclined sleeper present in the infant classroom during today's visit. This posed a potential health, safety or personal rights risk to persons in care.
