HSC 1596.8595(a)(1) · Type A

Each licensed child day care facility shall post a copy of any licensing report pertaining to the facility that documents either a facility visit or a complaint investigation that results in a citation for a violation that, if not corrected, will create a direct and immediate risk to the health, safety, or personal rights of children in care. The licensing report provided by the department shall be posted immediately upon receipt, adjacent to the postings required pursuant to Section 1596.817 and on, or immediately adjacent to, the interior side of the main door to the facility and shall remain posted for 30 consecutive days. This requirement has not been met as evidenced by: LIC 809 Facility Evaluation Report and LIC 809-D were not posted on the bulletin board along side the Notice of Site Visit issued on 4/13/23 which poses an immediate health and safety risk to children in care.

HSC1596.8595(c)(1) · Type A

A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as set forth in paragraph (1) of subdivision (a) of Section 1596.893b This requirement has not been met as evidenced by: LIC 809 Facility Evaluation Report and LIC 809-D were located inside the entrance of the center on a clipboard along with LIC 9224 Acknowledgement of Receipt of Licensing Reports. Per review of the clipboards, not all parents received and signed the LIC 9224 as required for a type A violation which is an immediate risk to the health and safety of children in care.

This requirement is not met as evidenced by: Based on record review and interview, the licensee did not comply with the section cited above due to Staff S1, S2, and S3 not having the required early childhood education (ECE) units to be a teacher and is considered a teacher's aide which poses an immediate health and safety risk to children in care. To be qualified as a teacher, an employee must have completed at least 6 semester units of ECE and enrolled in at least 2 semester units at a college to be fully qualified.

Last emergency drill was conducted on March 18, 2022 which poses a potential health and safety risk to children in care.
