(f) Cribs shall be free from all loose articles and objects, including blankets and pillows. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by having a cushion in a crib with a napping infant which poses a potential health, safety or personal rights risk to persons in care.
(d) Swings, playpens and all such equipment and furniture shall be assembled or installed according to the manufacturer's instructions, and shall be maintained in good repair and safe condition. (2) A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Section 1596.846. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by having four bouncers present and in use by infants which poses a potential health, safety or personal rights risk to persons in care.
(C) An infant shall not be swaddled while in care. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above by having infants napping with sleep sacks on which poses a potential health, safety or personal rights risk to persons in care.
(E) If an infant falls asleep before being placed in a crib, staff shall move the infant to a crib as soon as possible. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by having a napping infant in a baby bouncer, which poses a potential health, safety or personal rights risk to persons in care.
(a) Prior to the infant's first day at the center, the infant care center director or assistant director shall complete a needs and services plan for the infant. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above by not having a needs and services plan for infants in care which poses a potential health, safety or personal rights risk to persons in care.
Staff-Infant Ratio (b) There shall be a ratio of one teacher for every four infants in attendance. This requirement has not been met as evidenced by: LPA Marie Rodriguez observed upon arrival to the facility that there was only one teacher with six infants in care which poses an immediate health and safety risk to children in care.
(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (2) Request a transfer of a criminal record clearance as specified in Section 101170(f) or This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in 2 out of 4 staff which poses an immediate health, safety or personal rights risk to persons in care.
(1) Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. (B) A copy of the signed LIC 9052 (11/94) shall be kept in the employee's personnel record. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in 1 out of 4 staff which poses a potential health, safety or personal rights risk to persons in care.
(a) The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: (7) Past experience, including types of employment and former employers. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in 1 out of 4 staff which poses a potential health, safety or personal rights risk to persons in care.
(c) To be a fully qualified infant care teacher, a teacher shall have the following: (1) Completion, with passing grades, of 12 postsecondary semester or equivalent quarter units in early childhood or child development education at an accredited or approved college or university. (A) At least three of the units required in (c)(1) above shall be related to the care of infants or shall contain instruction specific to infants. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in 1 out of 4 staff which poses a potential health, safety or personal rights risk to persons in care.
Each licensed child day care facility shall post a copy of any licensing report pertaining to the facility that documents either a facility visit or a complaint investigation that results in a citation for a violation that, if not corrected, will create a direct and immediate risk to the health, safety, or personal rights of children in care. The licensing report provided by the department shall be posted immediately upon receipt, adjacent to the postings required pursuant to Section 1596.817 and on, or immediately adjacent to, the interior side of the main door to the facility and shall remain posted for 30 consecutive days. This requirement has not been met as evidenced by: LIC 809 Facility Evaluation Report and LIC 809-D were not posted on the bulletin board along side the Notice of Site Visit issued on 4/13/23 which poses an immediate health and safety risk to children in care.
A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as set forth in paragraph (1) of subdivision (a) of Section 1596.893b This requirement has not been met as evidenced by: LIC 809 Facility Evaluation Report and LIC 809-D were located inside the entrance of the center on a clipboard along with LIC 9224 Acknowledgement of Receipt of Licensing Reports. Per review of the clipboards, not all parents received and signed the LIC 9224 as required for a type A violation which is an immediate risk to the health and safety of children in care.

This requirement has not been met as evidenced by: Per LPA's observation at 4:30pm, there were two teachers and one teacher's assistant with 14 infants in the classroom. This poses an immediate health and safety risk to children in care.

(d) Disaster drills shall be conducted at least every six months. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Last emergency drill was conducted on March 18, 2022 which poses a potential health and safety risk to infants in care.
