The licensee shall take measures to keep the center free of flies, other insects, and rodents. This requirement is not met as evidenced by: Based on observations and interviews, the director did not comply with the section cited above as ants were observed to be present near the refrigerator where food is kept and in one (1) cubby, which poses a potential health and safety risk to persons in care.
There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. Physical Environment 101238 Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety...... Based on the LPA obersavations, staff reporting party and parent interviews, the condition of the facility indicates that the facility failed to be free from pest. ALLEGATION(S): Facility is out of ratio INVESTIGATION FINDINGS: On 7/6/23 at, 9:45 AM Licensing Program Analyst (LPA) Michael Mathew conducted an unannounced inspection to conclude a complaint investigation and completed a COVID-19 pre-screening questions prior to entering the facility. LPA met with Director Priya Sudharsan and advised her the purpose of the inspection. Director provided LPA a tour of the facility inside and out. There were 32 children and 7 staff in care at the time of the inspection. Allegation: Facility is out of ratio. During the investigation, LPA interviewed staff members, and parents. Based on interviews conducted, there is not a preponderance of evidence to prove the alleged violation did or did not occur, meaning the allegations may have happened or are valid. Therefore, the allegations are deemed UNSUBSTANTIATED. Report was reviewed and a notice of site visit was given and must remain posted for 30 days. Exit interview was conducted with director Priya Sudharsan Unsubstantiated Estimated Days of Completion:
(a) The licensee shall ensure that each child is accorded the following personal rights... (3) To be free from... infliction of pain... This requirement was not met as evidenced by: Based on review of security camera footage, a staff member had pulled on a child's arm, accidentally causing a dislocated or "nursemaid's" elbow.
101229(a)(1)Responsibility for Providing Care and Supervision:(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation Based on the interview and record review, the facility did not comly with the section cited above.C1 left the building and was brought back in by a bystander who observed C1 leaving which poses an immediate health and safety risk to children in care.

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on observation and (record review, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care.LPA observed one staff members with a expired mandated reporter training certificate, director stated that Staff forgot to update mandated reporter training.
(1) Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement is not met as evidenced by: Based on record review of S2, the licensee did not comply with the section cited above in which person poses a potential health, safety or personal rights risk to persons in care.
(b) Each record shall contain information including, but not limited to, the following: (7) Name, address and telephone number of the child's physician and dentist and any other medical/dental or mental health providers. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in identifiers which poses/posed a potential health, safety or personal rights risk to persons in care.
(2) All prescription and nonprescription medications shall be maintained with the child's name and shall be dated. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in objects which poses/posed a potential health, safety or personal rights risk to persons in care.
