(h) Infant changing tables shall: (1) Have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic. This requirement is not met as evidenced by: At 9:00AM., Based on observation, LPA confirmed diaper changing tables (2) do not have a soft, washable padded surface. This poses a potential health and safety risk to children in care.

CCR 101429(a)(2)(C)(3) · Type B

(C) Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following: (3) Time of each 15-minute check This requirement is not met as evidenced by: At 11:15PM., Based on record review, LPA confirmed review for infant napping conditions are not being conducted every 15 minutes. This poses a potential health and safety risk to children in care.

CCR 101427(c) · Type B

101427 Infant Care Food Service (c) The infant shall be fed in accordance with the individual plan. This requirement was not met as evidenced by: Based on interviews and unusual incident report, LPA determined C1 was mis-fed the wrong breast milk bottle, that belong to C2. This poses a potential health, safety or personal rights risk to children in care.

CCR 1597.16(a)(1) · Type B

A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement was not met as evidence by: Based upon record review, the facility did not comply with the above by not conducting lead testing until 1/10/2023, which posed a potential health, safety, or personal rights risk to persons in care.

Unsubstantiated

ALLEGATION(S): Facility staff are not providing day care children sufficient care and supervision. Day care children are being bitten while in care. Facility is not meeting day care children's diapering needs. Facility is not meeting day care children's hygiene needs. INVESTIGATION FINDINGS: On November 8, 2022 at approximately 8:15am, Licensing Program Analyst (LPA) Catrina Quimbo conducted an unannounced, complaint visit to Bright Horizons @ Gilead (Infant) center. LPA met with health and safety director, R.M., and center director, M.L., and explained the purpose of the visit. At the start of LPA's visit was drop off time with staff and children arriving to facility. Facility is licensed to operate out of 6 classrooms. Under infant license, there are 2 classrooms: Starfish and Seahorse. At approximately 9:30am, there were 5 children with 3 staff present in Starfish classroom and 7 children with 4 staff in Seahorse classroom. As part of this investigation, LPA conducted classroom observsations, reviewed program's records and documents, interviewed random selection of staff and interviewed random selection of enrolled children's parents. LPA conducted unannounced, classroom observations in Seahorse classroom. During classroom observations, LPA observed staff to provide day care children with sufficient care and supervision, observed staff changing multiple enrolled children's diapers and observed staff to maintain children's hygiene needs by washing hands and sanitizing the classroom.
