101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as by: Based on interviews, observations, and review of pertinent documentation. The facility failed to provide a surface sufficient to cushion falls, which posed a potential health, safety or personal rights risk to persons in care. this violates the personal rights of children in care.

CCR 101229(a)(1) · Type B

LACK OF SUPERVISION: 101229(a)(1) Care and Supervision. No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1). Based on the facility's self report, this requirement was not met as a child was left unsupervised. This poses an immediate health and safety risk to children in care.

ALLEGATION(S): Staff hit child in care Child sustained unexplained bruising while in care Staff handled daycare child in a rough manner INVESTIGATION FINDINGS: On January 16th, 2025 at approximately 9:30am, Licensing Program Analyst (LPA) Tapia-Mandujano conducted a subsequent unannounced visit to the facility to deliver investigation findings in response to the above allegation that was made to the Child Care Licensing Division (CCLD) on 10/22/24. LPA met with Director of Finance and Operations, Ana Guanzon and explained the purpose of the visit. During today's inspection, there were 40 preschool age children being supervised by 6 staff during nap time. All staff observed during today's inspection are fingerprint cleared and associated. During today’s visit, LPA conducted a health and safety inspection and conducted two additional staff interviews. During the course of the investigation, LPA conducted both staff and parent interviews, conducted health and safety inspections, and received pertinent documentation. LPA determined that based on the information obtained there is not sufficient evidence to prove that: Staff hit child in care, Child sustained unexplained bruising while in care, and/ or staff handled daycare child in a rough manner. Although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED. Upon receipt of this report, Licensee shall post the Notice of Site Visit. Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain postings as required, will result in an immediate $100 civil penalty. This report is public and can be reviewed. After today’s visit, an exit interview was conducted, report was reviewed and copy was provided to with Director of Finance and Operations, Ana Guanzon. Unsubstantiated Estimated Days of Completion:

1010170(e)(2) Criminal Record Clearance (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (2) Request a transfer of a criminal record clearance as specified in Section 101170(f) This requirement was not met as evidenced by: Based on record review it was found that 3/11 preschool staff were not associated to the preschool program. This poses an immediate health and safety risk to children in care.

101238(g) Building and Grounds(g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. This requirement was not met as evidenced by: Based on observations it was found in all three classrooms that cleaning products were accesible to children. As well as LPA observed child opening the safety locks put in place for the cabinets. This poses an immediate health and safety risk to children in care.

This requirement was not met as evidenced by: Based on interviews and record reviews, this requirement was not met as it was stated that staff innaporpriatley handle children in care. This poses an immediate health and safety risk to children in care.

(2) Licensees shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care. This requirement was not met as evidenced by: Based on record review of the water sampling database, the facility was not in compliance with the above as of the initial water results uploaded on 9/23/2022. This posed a potential health, safety, or personal rights risk to persons in care.
