§1596.8595 (c)(1) A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as set forth in paragraph (1) of subdivision (a) of Section 1596.893b. (2) Upon enrollment of a new child in a facility, the licensee shall provide to the parents or legal guardians of the newly enrolling child copies of any licensing report that the licensee has received during the prior 12-month period that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as set forth in paragraph (1) of subdivision (a) of Section 1596.893b. This requirement is not met as evidenced by: Based on interview and records review, the licensee did not comply with the section cited above because all six children’s records reviewed today did not contain the LIC 9224 forms related to the Type A citations issued on 08/13/2025 which poses a potential health, safety or personal rights risk to persons in care.

CCR 102370(d)(1) · Type B

102370 Criminal Record Clearance(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (1)Obtain a California clearance or a criminal record exemption as required by the Department or (2) Request a transfer of a criminal record clearance as specified in Section 102370(j) or (3) Request and be approved for a transfer of a criminal record exemption, as specified in Section 102370.1(p), unless, upon request for a transfer, the Department permits the individual to be employed, reside or be present at the facility. The requirement was not met as evidenced by: S1 did not have fingerprint clearance during LPA's visit on 08/01/2025 which posed a potential risk to the health and safety of the children in care.

CCR 102402(a)(3) · Type A

102402 Revocation or Suspension of a License or Registration (a) The Department shall have the authority to suspend or revoke any license for the following reasons: (3) Conduct in the operation or maintenance of a family day care home which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of the State of California. This requirement is not met as evidenced by: Based on records review, observation and interviews, licensee misrepresented the identity of S1 on 08/01/2025, which posed a immediate risk to the health and safety of the children in care.

CCR 102416.5(e) · Type A

102416.5 Staffing Ratio and Capacity (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement was not met as evidenced by: When the LPA visited the facility on 08/01/2025, the licensee was not present upon arrival. Only one adult attendant, who had not completed fingerprint clearance at that time, was supervising nine children which posed a immediate risk to the health and safety of the children in care.
