ALLEGATION(S): Day care child sustained unexplained injuries due to staff abuse or neglect while in care. INVESTIGATION FINDINGS: On February 20, 2026 at approximately 9:30AM, Licensing Program Analyst (LPA) Katie Krenn arrived at the child care center unannounced to close the complaint investigation into the above allegation. LPA met with the Assistant Director, Ilaise Meli. Present during the visit in addition to Assistant Director were two staff supervising five infants. During the course of the investigation, LPA conducted interviews, observations, and reviewed pertinent documentation provided by parties involved. Although the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. An exit interview was conducted with the Assistant Director, Ilaise Meli. A printed copy of the report and notice of site visit were provided at the conclusion of the inspection. Notice of site visit must remain posted for 30 days for public review. Unsubstantiated Estimated Days of Completion:
(a)(1) Each licensed child day care facility shall post a copy of any licensing report pertaining to the facility that documents either a facility visit...that results in a citation for a violation that, if not corrected, will create a direct and immediate risk to the health, safety, or personal rights of children in care. The licensing report provided by the department shall be posted immediately upon receipt, adjacent to the postings required pursuant to Section 1596.817... This requirement is not met as evidenced by: Based on observation, LPA determined that a copy of the licensing report was not posted anywhere in the faclity.
1596.817 (a) When the department conducts a site visit of a licensed child day care facility, the department shall post on, or immediately...adjacent to the postings required pursuant to section 1596.8595, a notice...that includes all of the following: (1) The date of the site visit. (2) Whether the facility was cited for violating...regulations...of the following categories was cited: (A) A violation that, if not corrected, will have a direct and immediate risk to the health, safety, or personal rights of children in care. This requirement is not met as evidenced by: Based on observation, LPA determined that a copy of the licensing report was not posted anywhere in the faclity.
(c)(1) A licensed child day care facility shall provide to the...guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care...(3) The licensee shall require each recipient...to sign a statement indicating that he or she has received the document and the date it was received. (4) The licensee shall keep verification of receipt in each child's file. This requirement is not met as evidenced by: Based on record review, LPA reviewed the records of all the enrolled infants and none of the files included a LIC 9224 form, acknowledging the receipt of licensing reports.
101160 Posting of License (a) The license shall be posted in a prominent, publicly accessible location in the center. This requirement is not met as evidenced by: Based on interview with assistant director and observation of the area where parents pick up and drop off children. LPA determined that the license is not posted in a prominent, publicly accessible location which poses a potential health, safety or personal rights risk to persons in care.
This requirement is not met as evidenced by: (b) The center shall inform each child's authorized representative of the rights specified in (a) (1) through (8) above. (2) The center shall post a copy of the LIC 613A Personal Rights Form (9/96) in a prominent, publicly accessible area in the center. Based on interview with assistant director and observation of the area where parents pick up and drop off children. LPA determined that LIC 613A Personal Rights is not posted in a prominent, publicly accessible location which poses a potential health, safety or personal rights risk to persons in care.
(c) The licensee shall post the PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster in a prominent, publicly accessible area in the child care center at all times. This requirement is not met as evidenced by: Based on interview with assistant director and observation of the area where parents pick up and drop off children. LPA determined that PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster is not posted in a prominent, publicly accessible location which poses a potential health, safety or personal rights risk to persons in care.
(f) The licensee shall post signs at the entrance to the child care center that provide the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5 This requirement is not met as evidenced by: Based on interview with assistant director and observation of the area where parents pick up and drop off children. LPA determined that the telephone number of the local health department and information on child passenger restraint systems are not posted in an area regularly accessible to parents and caregivers which poses a potential health, safety or personal rights risk to persons in care.
(b) Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education or child development, and three postsecondary semester or equivalent quarter units related to the care of infants, at an accredited or approved college or university. This requirement is not met as evidenced by: Based on file review, LPA determined that none of the staff currently caring for infants has completed three postsecondary semester or equivalent quarter units related to the care of infants, which poses an immediate health, safety or personal rights risk to persons in care.
(g) All personnel...(1)Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement is not met as evidenced by: Based on file review, LPA determined that one staff is without verification of tuberculosis clearance, which poses an immediate health, safety or personal rights risk to persons in care.
(a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. Bas record review, the licensee did not comply with the above by not maintaining immunization records for all staff working with infants which poses a potential risk to the health, safety, or personal rights of infants in care.ed on
(d) All personnel records shall be maintained at the child care center and shall be available to the licensing agency for review. This requirement was not met as evidenced by: Based on record review, the licensee did not comply with the above by not maintaining complete personnel records available for review which poses a potential risk to the health, safety, or personal rights of children in care.
(C) An infant shall not be swaddled while in care. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by using sleep sacks for napping infants which poses a potential health, safety or personal rights risk to persons in care.
(d) All personnel records shall be maintained at the child care center and shall be available to the licensing agency for review. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above by not having staff files available for review which poses a potential health, safety or personal rights risk to persons in care.
(a) (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement was not met as evidenced by: Based on record review facility has not completed the required lead testing. This poses a potential health and safety risk to children in care.
(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(2)Request a transfer of a criminal record clearance as specified in Section 101170(f) This requirement was not met as evidenced by: Based on record review it was found that 5/7 staff were not associated to the facility. This poses a potential health and safety risk to children in care.
