ALLEGATION(S): Day care child received inappropriate form of discipline while in care INVESTIGATION FINDINGS: On 03/17/2025 at 11:00am, Licensing Program Analyst (LPA) Christina Uribe conducted an unannounced visit for the purpose of investigating a complaint regarding the above allegation and met with the licensee, Virginia MacWilliams. Also present at the time of today’s inspection are 8 children and 2 fingerprint cleared assistants/residents. This agency has investigated the complaint alleging that a day care child received inappropriate form of discipline while in care. LPA Uribe obtained relevant documents, conducted interviews, and made observations. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Report was reviewed and a notice of site visit was given and must remain posted for 30 days. Exit interview was conducted with licensee, Virginia MacWilliams. 102416.5 - Staffing Ratio & Capacity: (d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home shall be twelve children, no more than four of whom may be infants. This regulation was not met as evidenced by: The licensee is over capacity as there are 8 children in care today 7 of whom are under the age of 2 years resulting in an immedaite risk to the health, safety, or personal rights to children in care.

Criminal Record Clearance: 102370(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by: Observations made and evidenced collected has found that an uncleared adult has been present in the home during operating day care hours which poses an immediate risk to the health, safety, or personal rights to children in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as she does not have certification for Mandated Reporter Training which poses a potential health, safety or personal rights risk to persons in care.
