HSC 1596.8662(b)(1) · Type B

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the licensee and helper did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

CCR 102370(k) · Type B

(k) The licensee shall maintain documentation of criminal record clearances or criminal record exemptions of employees, volunteers that require fingerprinting and non-client adults residing in the facility. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care. Helper fingerprint is not associated to the facility

CCR 102416(c) · Type B

(c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care. Licensee CPR, 1st aid certificate has been expired.

HSC 1596.871(c)(1)(A) · Type A

Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above by having a person without fingerprint clearance in daycare, which poses an immediate health, safety, or personal rights risk to persons in care.

CCR 102417(g)(4)(A) · Type B

(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. (A) Storage areas for poisons, firearms and other dangerous weapons shall be locked. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above by having chemicals and the item which poses/poses a potential health, safety, or personal rights risk to persons in care.

CCR 102416(c) · Type B

(c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above by leaving children (one hour) with a person who does not have CPR which poses/posed a potential health, safety or personal rights risk to persons in care.

CCR 102416.3(a)(6) · Type A

(a) Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: (6) Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above by having children in an off-limit area, also no one was supervising them, which poses an immediate health, safety or personal rights risk to persons in care
