CCR 101216.3(a) · Type A

Teacher-Child Ratio - (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by: LPA observed two teacher's aides supervising 19 children in Room 1. This poses an immediate risk to the health, safety, and personal rights of children in care.

CCR 101223(a)(2) · Type A

Personal Rights - (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: On 10/08/25, staff did not maintain a safe environment to children due to lack of supervision which resulted in serious bodily injury to a child (C1) in care. This posed an immediate risk to the health, safety and personal rights of children in care.

CCR 101170(e)(1)&(2) · Type B

Criminal Record Clearance - All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department or (2) Request a transfer of a criminal record clearance as specified in Section 101170(f) . This requirement was not met as evidenced by: LPAs observed that three staff members (S1, S2 & S3) do not have fingerprint clearances associated to the facility. This poses a potential risk to the health, safety and personal rights to children in care.

CCR 101229(a)(1) · Type B

Responsibility for Providing Care & Supervision - (a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: There was lack of supervision when a child (C1) sustained an injury and no one among the staff observed how it happened. This poses a potential risk to the health, safety, and personal rights to children in care.

101700.3(b)(1) · Type B

Lead Testing Written Directives. A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement is not met as evidenced by: Sinks "E", "G" and "H" had a result of greater than 5.5 pbb. This poses a potential health and safety risk to children in care.

HSC 1596.7995(a)(1) · Type B

(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on record review, Staff #4 is missing immunizations in measles, pertussis and flu, Staff #8 is missing immunizations in pertussis and flu which poses a potential health, safety or personal rights risk to persons in care.

CCR 101216(g)(1) · Type B

(1) Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement is not met as evidenced by: Based on record review, Staff #3 and #7 are missing health screening report which poses a potential health, safety or personal rights risk to persons in care.

CCR 101212(d)(1)(B) · Type B

Reporting Requirements - (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (B) Any injury to any child that requires medical treatment. This requirement was not met as evidenced by: Licensee failed to report to Licensing an injury that occurred on 08/30/24 involving a daycare child (C1) who sustained an injury and 911 was contacted. This posed a potential risk to the health, safety, and personal rights to persons in care.

CCR101212(c) · Type B

Reporting Requirements - (c)The licensee shall notify the Department in writing of his/her intent prior to making any structural changes that reduce the total amount of indoor or outdoor activity space. Such structural changes shall include, but not be limited to, room additions. This requirement was not met as evidenced by: In August 2024, a full wall was constructed separating the nap area to the activity area and installed permanent bunk beds for children to nap, however Licensing was not notified of the structural changes. This posed a potential risk to the health, safety and personal rights to children in care.
