ALLEGATION(S): -Provider does not reside in the home INVESTIGATION FINDINGS: On 3/22/2024, at approximately 8:30AM, Licensing Program Analyst (LPA) Jonathan Tse conducted an unannounced complaint investigation visit. LPA was granted entry to the facility by Licensee, Tatiana Lozinscaia (L1). Present during the visit was L1, a helper (H1), H1's minor daughter, two infants and five preschool age children. During the course of the investigation, LPA conducted record review, site observations, and staff interviews. The provider denied the allegations. LPA observed the provider to be present upon entry to the facility. Based on interviews with relevant parties, review of relevant documentation, and LPA's observations, there is no direct evidence to prove that the allegation above did or did not occur. Based on relevant information reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated at this time. Appeal rights were provided to Licensee. A Notice of Site Visit was provided and must be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview was conducted and report was reviewed with Licensee, Tatiana Lozinscaia. Unsubstantiated Estimated Days of Completion:
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. As their age and ability permit, newly enrolled children shall be informed promptly of their duties as required in the plan. (A) Each family child care home shall conduct fire drills and disaster drills at least once every six months. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above by not conducted an emegrency drill at least once every six months, which poses a potential health, safety or personal rights risk to persons in care.
(b) Cribs or play yards shall be free from all loose articles and objects. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by not keeping two out of three cribs free of loose articles and objects which posed a potential health, safety or personal rights risk to persons in care.
The provider shall supervise infants while they are sleeping and adhere to the following requirements: If the infant is sleeping in a separate room from where the provider is stationed, the door to the room the infant is sleeping in shall remain open at all times. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above by not having a helper or provider stationed in Bedroom #3 with two napping infants, which posed a potential health, safety or personal rights risk to persons in care.
(d) All personnel records shall be maintained at the child care home and shall be available to the licensing agency for review. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above by not maintaining complete personnel records for all staff present which poses a potential health, safety or personal rights risk to persons in care.
(b) The licensee shall maintain, in each child's record, a copy of the emergency information card as required in Section 102417(g)(7). This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above by not maintaining a file for each child which contains an emergency information card which poses a potential health, safety or personal rights risk to persons in care.

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in not having current Mandated Reporter Certificates which poses a potential health, safety or personal rights risk to persons in care.
(c) The family day care home shall maintain documentation of the required immunizations or exemptions from immunization, as set forth in this section, in the person's personnel record that is maintained by the family day care home. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in not having any immunization on file for staff and herself which poses/posed a potential health, safety or personal rights risk to persons in care.
