ALLEGATION(S): Facility staff hit daycare child Staff yell at day care children INVESTIGATION FINDINGS: Licensing Program Analyst (LPA), Oscar Huang, conducted an unannounced subsequent complaining visit to the Facility today. LPA Huang met with Director, Lin Zhu and explained the nature of today's visit to her. Based on interviewed with staff, reviewed children files, hospital medical records, Santa Clara County Sherff's report, and LPA's own observations, the allegations listed above could not be proved or disproved. LPA concludes that although the allegations may have happened or are valid, there were not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegations are UNSUBSTANTIATED. Based on interviewed with staff, LPA's own observations and reviewed children files, as well as attempted children interviews but they were too young to obtain valid information, the allegations listed above could not be proved or disproved. LPA concludes that although the allegations may have happened or are valid, there were not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED. Teacher-Child Ratio. (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by: LPA observed classroom Caterpillar has 20 preschool children with 1 teacher and 2 aides, and classroom Ladybug has 23 preschool children with 1 teacher and 1 aide. This poses an immediately safety & health risk to children in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above that a new hire teacher does not has the mandated reporter taining certification which poses/posed a potential health, safety or personal rights risk to persons in care.
