Documentation shall include the following: Time of each 15-minute check This requirement is not met as evidenced by: Based on record review and interview, the licensee did not comply with the section cited above because LPA reviewed the infants’ sleeping logs and noted that in July only three days of sleep checks were documented, and in June the logs were also incomplete with some entries repeated. The licensee acknowledged that they sometimes forget to document which posed a potential health, safety or personal rights risk to persons in care.

Substantiated

ALLEGATION(S): Daycare staff mishandled a daycare child INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Kate Huang conducted an unannounced complaint visit to deliver investigation findings regarding the above allegation. LPA met with licensee, Huang, Shuang and explained the purpose of the visit. It was alleged that during a group activity, staff one (S1) grabbed a daycare infant (C1) and pulled C1 to the side alone in a corner, despite the child not misbehaving at that time. During the course of the complaint investigation, LPA toured the facility, interviewed the licensee, staff, and parents, and reviewed relevant records. Video footage taken on the morning of 11/05/2025 shows that when C1, who was under two years old, attempted to join the group activity, S1 grabbed C1 by the arm, pulled her aside, and moved her to the side, away from the group, leaving her alone, despite no observed unsafe behavior by the child. 102359(a)- Advertisements and License Number- (a) Licensees shall reveal each facility license number in all advertisements, publications, or announcements made with the intent to attract clients. This requirement was not met as evidence by: Based on evidence gathered during the investigation process, Licensee failed to include the facility license number is all advertisements. This poses a potential risk to the health safety and personal rights to children in care.

CCR 102425(j)(1) · Type B

The provider shall supervise infants while they are sleeping and adhere to the following requirements: The provider shall physically check on the infant every 15 minutes. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above for 4 infant uneder 2 years old which poses/posed a potential health, safety or personal rights risk to persons in care.

HSC 1597.622(a)(1) · Type B

(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above for two helpers which poses/posed a potential health, safety or personal rights risk to persons in care.

CCR 102417(g)(8) · Type B

(8) Each family child care home shall have a current roster of children as specified in Health and Safety Code Section 1596.841. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.
