101229 Responsibility for Providing Care and Supervision: (a) "The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation." This requirement was not met as evidenced by: Based on interview and record review, the facility did not comply with the section cited above as facility self-reported an incident where a toddler age child was left in outdoor playground during a transtion back into classroom for lunch,which poses a potential health, safety or personal rights risk to persons in care.
Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above as there was a staff (A1) present supervising children without a criminal backgroung cleared which poses an immediate health, safety or personal rights risk to persons in care.
(d) The sign-in and sign-out sheets with the signatures required by this section and by Section 101226.1 shall be kept for one month and shall be available at the center for review by the Department. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above as there were 13 out of 24 infants signed in which poses a potential health, safety or personal rights risk to persons in care.
