ALLEGATION(S): Licensee does not properly maintain the home Licensee speaks inappropriately towards day care child(ren) INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Mel Matos conducted an unannounced follow up complaint investigation and met with Shilpa Dalal. Purpose of today's follow up complaint investigation: deliver investigation findings. The investigation of the complaint allegation listed in this complaint was conducted by LPA Mel Matos. Based on the available evidence, including observations of the Facility, and interviews completed for the complaint investigation, it is concluded that although the allegation noted on this complaint may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. The allegation is thus UNSUBSTANTIATED. A NOTICE OF SITE VISIT WAS ISSUED, POSTED NEAR THE ENTRANCE TO THE FACILITY, AND MUST REMAIN POSTED FOR 30 DAYS. Unsubstantiated Estimated Days of Completion:

(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (10) A baby walker shall not be allowed on the premises of a family child care home in accordance with Health and Safety Code Sections 1596.846(b) and (c). This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. LPA observed one baby bouncer in the family room and three in the children's nap room. LPA reminded Licensee that baby walkers, bouncers and similar items are not allowed in family child care homes. Licensee removed the bouncers from the on limit areas during today's inspection.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on observation, interview and record review the licensee did not comply with the section cited above for Licensee and assistant/daughter which poses a potential health, safety or personal rights risk to persons in care.
Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following: Time of each 15-minute check This requirement is not met as evidenced by: Based on obsrvation, interview and record review, the licensee did not comply with the section cited above for four infants (C1, C2, C3 and C6) which poses a potential health, safety or personal rights risk to persons in care. Licensee is not conducting 15 minute nap checks for four infants in care. LPA reviewed safe sleep regulations with Licensee and advised Licensee that even though they are in the same room as the sleeping infants they are required to conduct and document the 15 minute sleep checks.
