CCR 101229(a)(1) · Type B

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on record review, the Licensee did not comply with the above by having two children leave the outdoor play area and enter a construction area, which posed a potential risk to the health, safety, and personal rights of children in care.

ALLEGATION(S): -Facility did not maintain a comfortable temperature. -Facility did not provide children with comfortable accommodations. INVESTIGATION FINDINGS: On August 20, 2026, at approximately 9:10AM, Licensing Program Analysts Tse and Alvarado conducted an unannounced complaint investigation visit at the facility. LPAs met with Assistant Director, J.S., and explained the purpose of the visit. Present during the visit were 9 teachers and 43 preschool age children. During the course of the investigation, LPAs conducted site observations and interviews with relevant parties. Based on site observations, LPAs observed there to be air conditioning units present. A portable cooler was also observed to be present. There are thermostats present in the classrooms that allow for temperature tracking and control. Temperatures of the inside of the classrooms are not documented. There is no direct evidence to support or deny the above allegations. Based on relevant information reviewed, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are unsubstantiated at this time. 101216.3:Teacher-Child Ratio: (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance... This requirement is not met as evidenced by: Based on observation and record review, the licensee did not comply with the section cited above. During the course of the investigation, it was determined by interviews, observations, and documentation that staff have been operating over staff to child ratio which poses an immediate health, safety or personal rights risk to persons in care.

HSC 1597.16(a)(1) · Type B

(1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as the facility tested on April 20th, 2023 past the due date od January 1st, 2023 which poses a potential health, safety or personal rights risk to persons in care.

CCR 101212(d) · Type B

101212: Reporting Requirements: (d): "Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. " This requirement was not met as evidenced by: Based on interview and record review, the facility did not comply with the section cited above as the facility failed to report the incident that occurred on 5/29/25 both verbally and in writing in a timely manner which poses a potential health, safety or personal rights risk to persons in care.

CCR 101161(a) · Type A

101161: Limitations on Capacity: (a): "(a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation." This requirement was not met as evidenced by: Based on observation, interview, and record review the facility did not comply with the section cited above as the facility has 94 preschool age children present with 124 enrolled children exceeding the licensed capacity of 91 preschool age children. This poses an immediate health, safety and personal rights risk to children in care.

CCR 101216.3(a) · Type B

101216.3:Teacher-Child Ratio: (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance... This requirement is not met as evidenced by: Based on observation and record review, the licensee did not comply with the section cited above. LPA observed two fully qualified teachers with 25 preschool children in Room 24 (Dragonflies), which poses a potential health, safety or personal rights risk to persons in care.

CCR 101229(a)(1) · Type A

101229: Responsibility for Providing Care and Supervision: (a) "The licensee shall provide care and supervision as necessary to meet the children’s needs (1) No child…shall be left without the supervision of a teacher…" This requirement was not met as evidenced by: Based on interviews and record review, a child (C1) was able to climb over the playground fence leaving the premise without the direct supervision of staff. This poses an immediate health, safety and personal rights risk to children in care.

ALLEGATION(S): Staff did not adequately supervise day care children. INVESTIGATION FINDINGS: This is an amended report. On March 6, 2025, at approximately 9:15 AM, Licensing Program Analyst (LPA) Katie Krenn arrived at the child care center unannounced to close the complaint investigation into the above allegation. LPA met with the Site Supervisor, Alicia Young. Present during the visit were the Site Supervisor/Teacher and nine teachers, supervising 51 preschool children. During the course of the investigation, LPA conducted interviews, observations, and pertinent documentation provided by parties involved. Although the above allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. An exit interview was conducted with the Site Supervisor and appeal rights were explained. A printed copy of the report, as well as a printed copy of the appeal rights, were provided at the conclusion of the inspection. ALLEGATION(S): Facility staff left day care children unattended while using the restroom INVESTIGATION FINDINGS: On January 24, 2024 at approximately 2:05am, Licensing Program Analyst (LPA) Maria Olguin-Leon conducted an unannounced visit to deliver complaint findings for the above allegation. LPA met with the Site Supervisor Alicia Young and explained the purpose of the visit. Present during today’s visit were Director, 10 staff and 56 children. Facility is operating within capacity. During the course of the investigation, LPA conducted interviews, observations and reviewed pertinent documentation provided by parties involved. Based on evidence obtained, it was determined that the allegation, Facility staff left day care children unattended while using the restroom, is determined to be UNSUBSTANTIATED. Although the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
