Personal Rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting. This requirement is not met as evidenced by: a child was not used to, nor wanted to take nap was forced to during nap-time that the facility did not comply with the section cited above which posed an potential health, safety or personal rights risk to persons in care.
(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on record review and interview, the licensee did not comply with the section cited above for two staff which poses a potential health, safety or personal rights risk to persons in care. Staff (C1 and C4) are missing immunizations for measles and staff, C1 is missing the Health Screening Report (LIC 503).
(f) At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities. This requirement is not met as evidenced by: Based on record review and interview, the licensee did not comply with the section cited which poses a potential health, safety or personal rights risk to persons in care. No staff member on site has a current CPR and First Aid certification on file. Director was reminded that there shall be at least one person, with valid CPR and First Aid certifications, on site at all times or present during off-site activities.
Lead Testing Written Directives - a result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement was not met as evidenced by: Based on record review, the Lead Sampling Report in one(1) identified faucet: Room 15, D, Sink Faucet had elevated lead above 5.5 ppb. This poses a potential risk to the health, safety, or personal rights of children in care.
