Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. Licensee's daughter Nekone Garay was present in the home for at least five days from 05/03/2024 through 09/21/2024 without fingerprint clearance which poses an immediate health, safety or personal rights risk to persons in care.
(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. LPA observed an infant sitting in a high chair not being fed which poses an immediate health, safety or personal rights risk to persons in care.
(a) Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: (2) Room additions to the family child care home. LPA observed room additions including a day care room and bathroom in the home. Licensee failed to inform the Department of changes which poses/posed a potential health, safety or personal rights risk to persons in care.
(g) The licensee shall document each child's immunizations as required by the California Code of Regulations, Title 17, Section 6070, and shall maintain such documentation for as long as the child is enrolled. (1) This requirement includes updating each child's PM 286 (6/95) when the child is due to receive required immunizations after enrollment in the family day care home. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Child 2, 3, and 5 immunization records need to be updated which poses/posed a potential health, safety or personal rights risk to persons in care.
(7) An emergency information card shall be maintained for each child and shall include the child's full name, telephone number and location of a parent or other responsible adult to be contacted in an emergency, the name and telephone number of the child's physician and the parent's authorization for the licensee or registrant to consent to emergency medical care. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Child 2 is missing LIC627 which poses/posed a potential health, safety or personal rights risk to persons in care.
