HSC 1596.8662(b)(1) · Type B

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. CCR 101216(f) · Type B

(f) At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above in 2 out of 2 staff have not completed CPR/First aid training, which poses/posed a potential health, safety or personal rights risk to persons in care.

CCR 101218.1(e)(1) · Type B

101218.1 Admission Procedures and Parental and Authorized Representative's Rights (e) At the time of acceptance of each child into care and for all children in care on August 7, 2002, the licensee shall give each parent or authorized representative a copy of the Notification of Parents' Rights (LIC 995 [8/02]) and the LIC 995E, Caregiver Background Check Process form. (1) The licensee shall request the child’s parent or authorized representative to sign and date the acknowledgement-of-receipt statement at the bottom of the LIC 995 (8/02). The bottom portion of this form must be kept in the child's file as proof that the parent or authorized representative has been notified of his or her rights by the child care center and received a copy of the LIC 995E, Caregiver Background Check Process form. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above in 4 out of 4 children's files did not have a signed copy of LIC995 Parents Rights, which poses/posed a potential health, safety or personal rights risk to persons in care.

ALLEGATION(S): Staff do not provide adequate care and supervision of the daycare children Staff yell at the daycare children INVESTIGATION FINDINGS: On November 22, 2024 @ approx. 12:15pm, Licensing Program Analyst (LPA) Maria Olguin-Leon, conducted an unannounced visit to close the complaint investigation into the above allegations and met with Director R.B.A. Present during today’s visit was Director, 1 staff and 7 children. During the Investigation, LPA conducted file reviews, interviewed staff, parents, and conduct three unannounced visits. During the course of the investigation, LPA was unable to determined staff do not provide adequate care and supervision of the daycare children and staff yell at the daycare children. Based on investigation and information gathered, the preponderance of evidence standard has not been met. Although the above allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED. This report and exit interview were conducted with Director, R.B. Abad. Notice of Site Visit shall remain posted for 30 days. 101216.1 Teacher Qualifications and Duties(b)Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below: (1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1) below, or shall have obtained a Child Development Assistance Permit issued by the California Commission on Teacher Credentialing. 101223(a)(3)Personal Rights (a) (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature... This requirement is not met as evidenced by: LPAs overheard Director using a loud firm voice and scolding a child in care. LPAs interviewed Director regarding incident. This posed a potential health, safety, or personal rights risk to the persons in care.

1596.841 Current roster of children provided care in facility required Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request. This requirement is not met as evidenced by: Facility did not have a facility roster available for review. This posed a potential health, safety, or personal rights risk to the persons in care.

101238 Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. Based on tour of facility, LPAs observed ants on the kitchen counter of the facility. This posed a potential health, safety, or personal rights risk to the persons in care.

(1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test.
