ALLEGATION(S): Personal Rights INVESTIGATION FINDINGS: On 12/9/2022 Licensing Program Analyst (LPA) Morgan Pringle met with facility staff Weija for a complaint that was received alleging children's personal rights were violated. Present during the inspection were seventy-six (76) children, two (2) volunteers and nine (9) staff members. During LPA's inspection interviews were conducted and a tour of the facility was taken. LPA obtained the new facility roster, new personnel roster, and a sample of the staff files that were not present during LPA's previous inspection. LPA determined although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore, the allegation is UNSUBSTANTIATED. Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on LPA observation, interview, and record review, the licensee did not comply with the section cited above as 3 additional staff present at the facility today have eligible fingerprint clearances but are not associated to this facility. Also, one (1) volunteer present at the facility did not have a fingerprint clearance, which poses an immediate health, safety or personal rights risk to persons in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as 3 of 8 staff files reviewed by LPA did not have current Mandated Reporter training certificates. Director's Mandated Reporter training recently expired, which poses/posed a potential health, safety or personal rights risk to persons in care.
(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as 3 of 8 staff files reviewed by LPA did not have proof of immunizations for MMR (measles), Tdap (pertussis), and/or flu, which poses/posed a potential health, safety or personal rights risk to persons in care.
(1) Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as 3 of 8 staff files reviewed by LPA did not have signed LIC 503 Health Screening report and/or negative TB test results, which poses/posed a potential health, safety or personal rights risk to persons in care.

101216.1(g) A photocopy of the teacher's Child Development Permit as specified in (c)(3) above, or a photocopy of the teacher's transcript(s) documenting successful completion of required course work, shall be maintained at the center. This requirement was not met as evidenced by: Three (3) staff members were missing transcripts which poses a potential risk to the health and safety of the children in care.

101216.3(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This requirement was not met as evidenced by: Room one (1) and room (2) were out of ratio during LPA's visit due to two (2) staff members not having proof of transcripts.
(i) Prior to employment or initial presence in the child care center, all employees and volunteers subject to a criminal record review shall: (1) Obtain a California clearance or a criminal record exemption as required by law or Department regulations or... This requirement was not met as evidenced by: There were one (1) staff on site did not have a cleared criminal record clearance transfer association. This poses a immediate safety & health risk to the children in care.
101216(f) At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities. This requirement was not met as evidenced by: None of the staff members on site have a certification in Pediatric CPR & First Aid. This poses a potential safety & health risk to children in care.
