ALLEGATION(S): Other (Overall Operations): Licensee is not living in the home. INVESTIGATION FINDINGS: On 08/02/2024 at 8:50am, Licensing Program Analyst (LPA) Jialing "Julianne" Zhu and Licensing Program Manager (LPM) conducted an UNANNOUNCED COMPLAINT SITE INSPECTION. LPA met with Staff 1 (S1). Licensee was not at the facility. S1 states licensee, Oscar Corona Heredia, stepped out momentarily to buy supplies for the facility. Licensee arrived at facility at 8:58am. A complaint regarding other (overall operations) was filed against the facility. LPA toured the facility for health and safety inspection. Present during the inspection was two (2) fingerprint-cleared staff and six (6) children (3 infants and 3 preschool-age children). This agency has investigated the complaint alleging licensee is not living in the home. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Report was reviewed, and a Notice of Site Visit was given and must remain posted for 30 days. Exit interview was conducted with the licensee, Oscar Corona Heredia. Appeal Rights also provided to licensee. Unsubstantiated Estimated Days of Completion:
(d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either: (1) Twelve children, no more than four of whom may be infants; or This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above as 5 of 8 children present during the inspection were infants (0-24 months), which poses/posed a potential health, safety or personal rights risk to persons in care.
