ALLEGATION(S): Daycare child sustained unexplained injuries while in care. INVESTIGATION FINDINGS: On January 13th, 2025 at approximately 9:30am, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an unannounced, complaint investigation and met with licensee, Maria Isabel Andino to deliver the findings of the above allegation. LPA explained the purpose of the visit to licensee. LPA toured the home for health and safety hazards. Present in the facility are licensee and assistant supervising 8 children (2 infants and 6 preschoolers). All adults working or living in the facility have fingerprint clearance and are associated. Complaint was received by the Department on 10/17/24. During the course of the investigation, interviews were conducted with licensee, parents, assistant, and involved parties. LPA also gathered pertinent documents. The investigation determined there is not enough available information to prove that a daycare child sustained unexplained injuries while in care. Per interviews conducted, any accidents/injuries that happen are communicated with families with a picture of injuries or verbally at pick up. Although the allegations above may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED. Exit interview was conducted and report was reviewed with License, Maria Isabel Andino and copy of this report was provided. Report was translated into Spanish by LPA Tapia-Mandujano to licensee. Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain postings as required, will result in an immediate $100 civil penalty. This report is public and can be reviewed. (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above as upon arrival of LPA, assistant was supervising 8 children (4 infants and 4 preschoolers) without an additional assistant making the facility be over capacity which poses an immediate health, safety or personal rights risk to persons in care.
Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following: Time of each 15-minute check This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above as she is not maintaining the safe sleep logs for children under 24 months which poses a potential health, safety or personal rights risk to persons in care.
