ALLEGATION(S): Lack of supervision resulting in daycare children engaging in inappropriate behavior. INVESTIGATION FINDINGS: Licensing Program Analyst (LPA), Marilou Monico, made a follow up complaint investigation and to deliver findings. LPA met with Licensee, Liz Andrea Quintero. LPA interviewed children and Licensee's two adult assistants. During the course of the investigation, LPA conducted observations, interviewed licensee, licensee's husband, parents, assistants and children, and reviewed records. Based on interviews, they have not observed the children without adult supervision. Based on interviews, when children are harming other children, they usually separate, redirect and talk to the kids. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. There were no deficiencies cited. A Notice of Site Visit was issued and must remain posted for 30 days. Unsubstantiated Estimated Days of Completion:
Personal Rights - Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidenced by: Staff restrain children in highchairs as a form of discipline and place children in highchairs during activities. This pose an immediate risk to the health, safety, and personal rights of children in care.

(d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either: (1) Twelve children, no more than four of whom may be infants; or This requirement is not met as evidenced by: Based on LPAs observations and record review, Licensee's two helpers (S1 & S2) were supervising five infants and five preschool age which poses an immediate health, safety or personal rights risk to persons in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, Licensee's helper (S2) is missing Mandated Reporter Training certificate on file which poses a potential health, safety or personal rights risk to persons in care.
