Responsibility for Providing Care and Supervision: No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on the facility's self report, this requirement was not met as a child was left unsupervised for approximately 7 minutes. This poses an immediate health and safety risk to children in care.

(b) All licensed Child Care Centers operating in buildings constructed before January 1, 2010, shall test their water for lead pursuant to these written directives. This requirement is not met as evidenced by: Based on observation and record review, the licensee did not comply with the section cited above by not completing lead testing by January 1, 2023 which poses a potential health, safety or personal rights risk to persons in care.

Unsubstantiated

ALLEGATION(S): Unqualified staff left alone with day care children. Staff did not ensure they were not out of ratio. Staff handled day care child in a rough manner resulting in injury. INVESTIGATION FINDINGS: On July 2th, 2024 at approximately, 9:00 AM, Licensing Program Analysts (LPAs) Melissa Zaragoza and Catrina Quimbo conducted an unannounced, complaint visit. LPAs met with director, G.C., and the purpose of the visit was explained. Present in the facility today was 11 staff (including director and inclussion director) and 44 preschool children. Durring investigation, LPA conducted classroom observations, reviewed facility records, interviewed random selection of staff, and interviewed random selection of children. After conducting staff interviews, staff stated, ratio is maintained at all times. During classroom observations, LPA observed teacher to child ratio was met. Each class has at least two staff memebers. After reviewing facility records, it is confirmed staff present meet teacher qualifications. After investigating the allegation of staff handling child in a rough manner and resulting in an injury, children interviewed stated teachers are not physical with children. Per children interviewed, when children misbehave, children take a "break" in calming area. Per children interviewes, they are content with staff and like school. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated. Supervision shall include visual observation.This requirement is not met based on it being reported a child (C1) was left unsupervised in an adjacent play yard for approximately 15 minutes before staff/teachers were aware. This is an immediate health and safety risk.

Unsubstantiated

ALLEGATION(S): Child was injured by another child in care due to inadequate supervision INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Andrea Medlin met with facility representative for this conclusionary complaint visit. Purpose of visit explained. There was an incident at facility in April 2023 where a child (C1) caused injury to another child (C2). This was an unfortunate incident that happened very quickly that staff in the classroom could not stop it in time. The incident happened in the "rainforest" classroom which typically always has at least three teachers and during the morning C1 is provided one-to-one support. Facility has taken action due to the incident including more frequent monitoring in the classroom and other support as needed. There are 18 children enrolled in this particular classroom always with a minimum of three teachers. Facility is well within ratio of the required 1:12 staff/child required ratio. This requirement is not met, as evidenced by the staff interview and record review. C1 was not accounted for and left unsupervised in the yard, outside the Arctic classroom door. This poses an immediate health and safety risk to children in care.
