ALLEGATION(S): Staff had an inappropriate interaction with daycare child Staff do not prevent daycare child from hitting other children in care Staff pushed daycare child INVESTIGATION FINDINGS: On June 7th, 2024 at approximately 8:20am, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an unannounced 10- day complaint inspection in response to the above allegations. LPA met with Director, Beatrice Balfour and explained the purpose of the visit. Complaint Report was received 03/12/24. Last day of Preschool program was 6/6/24. During today's inspection there are no children present. Present during the inspection are Director and 2 staff. All staff present during today's inspection are fingerprint cleared and associated. During today’s visit, LPA conducted a health and safety inspection, and received pertinent documentation from Director. During the course of the investigation, LPA conducted interviews, and received pertinent documentation. LPA determined that based on the information obtained there is not sufficient evidence to prove that Staff had an inappropriate interaction with daycare child, Staff do not prevent daycare child from hitting other children in care, and/or Staff pushed daycare child. Although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED. Upon receipt of this report, Licensee shall post the Notice of Site Visit. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain postings as required, will result in an immediate $100 civil penalty. This report is public and can be reviewed. After today’s visit, an exit interview was conducted, report was reviewed and copy was provided to Director, Beatrice Balfour. Unsubstantiated Estimated Days of Completion:
ALLEGATION(S): Unqualified staff providing care to day care children INVESTIGATION FINDINGS: On March 18th, 2024 at approximately 9:45am, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an unannounced 10- day complaint inspection in response to the above allegation. LPA met with Director, Beatrice Balfour and explained the purpose of the visit. Present during inspection was Director and five other staff caring for a total of 24 preschool age children. All staff present have fingerprint clearance and are associated. During today’s visit, LPA conducted a health and safety inspection and interviewed two additional staff. During the course of the investigation, LPA conducted file review, interviews with staff, and received pertinent documentation. LPA determined that based on the information obtained there is not sufficient evidence to prove that unqualified staff providing care to day care children. Although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED. 101216.2(d)(1): Teacher Aide qualifications and Duties:(d) An aide assisting a fully qualified teacher (as specified in Section 101216.1(c))... shall meet the following requirements: (1) Completion of six postsecondary semester or equivalent quarter units in early childhood education or child development. This requirement is not met by evidence of: Based on interviews and record review, the facility did not comply with the section cited above as S3 and S7 are left alone supervising children without having any educational units, which poses a potential health, safety or personal rights risk to persons in care.
ALLEGATION(S): Staff member handles daycare children in a rough manner Staff member threatens daycare children Facility is operating out of ratio INVESTIGATION FINDINGS: On July 25th at approximately 1:30pm, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an announced, complaint investigation and met with Director, Beatrice Balfour regarding above allegations. LPA scheduled visit due to the facility currently being closed for Summer Break. LPA did not do a health and safety tour due to no children being present. LPA reviewed six staff files during today’s inspection. Complaint was received by the Department on 04/28/23. Present in the facility are Director and a couple staff prepping for the new year. All adults working in the facility have fingerprint clearance and are associated with the facility. During the course of the investigation, LPA conducted file review, interviews with staff, and received pertinent documentation. LPA did not have enough information to determined that staff member handles daycare children in a rough manner and/or that Staff member threatens daycare children. This requirement was not met as evidenced by: Based on record review of the water sampling database, the facility did not comply with the Written Directives by not testing before the deadline of 1/1/2023, which posed a potential health, safety, or personal rights risk to persons in care.
(2) Licensees shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care. This requirement was not met as evidenced by: Based on record review of the water sampling database, the facility did not comply with the above by having an ALE in two fixtures.
