(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as there are staff that have no immunization record on files which poses a potential health, safety or personal rights risk to persons in care.
(b) There shall be a ratio of one teacher for every four infants in attendance. (1) An aide may be substituted for a teacher when all of the following conditions are met: (B) Each aide is responsible for the direct care and supervision of a group of no more than four infants. This requirement is not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above as there are 9 infant children with one lead teacher and one fully qualified aide. Classroom did have 3 additional staff that have no qualifying units. This poses a potential health, safety or personal rights risk to persons in care.
101116(a): Limitations on Capacity: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met by: Based on observation and interview, the licensee did not comply with the section cited above as LPAs had observed on 10/10/23, that additional child size gates were installed and the license certificate states "all exits and gates must remain unlocked, unobstructed, and accesible during business hours" operating outside of the license limitations which poses a potential health, safety or personal rights risk to persons in care.
(d) Swings, playpens and all such equipment and furniture shall be assembled or installed according to the manufacturer's instructions, and shall be maintained in good repair and safe condition. (2) A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Section 1596.846. This requirement is not met as evidenced by: Based on observation, the director did not comply with the section cited above which posed a potential health, safety or personal rights risk to persons in care.
