Child day care centers serving preschool age children; optional program - A ratio of six children to each teacher is maintained for all children in attendance at the toddler program. An aide who is participating in on-the-job training may be substituted for a teacher when directly supervised by a fully qualified teacher. This requirement was not met as evidenced by: A staff (S-3) who is missing .5 quarter unit related to infant care was left supervising a child who is under 2 years old in Room 1 (toddler option room). This poses a potential risk to the health, safety, and personal rights, to children in care.

Fixtures, Furniture, Equipment and Supplies - The licensee shall provide a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities. This requirement was not met as evidenced by: LPA observed broken building blocks with sharp edges in the crates located in the playground. This poses a potential risk to the health, safety, and personal rights to children in care.
Personal Rights - The licensee shall ensure that each child is accorded the following personal rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: The children lay down on the floor carpet during quiet time without a cot or mat. This poses a potential risk to the health, safety, or personal rights to children in care.
Teacher-Child Ratio - There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by: A teacher was alone supervising 14 children in Room 4 when the assistant teacher left the classroom. This poses an immediate risk to the health, safety, and personal rights to children in care.

(g) All personnel, including the licensee, administrator and volunteers, shall be in good health and shall be physically and mentally capable of performing assigned tasks. (1) Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. (2) Each person specified in (g) above shall have a health-screening report signed by the person performing the screening. Because the facility repeated a violation within 12 months, an immediate civil penalty of $250 was assessed. A civil penalty of $100 per day continues until the violation is corrected.
Criminal Record Clearance - All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f). This requirement was not met as evidenced by: S-1 and S-2 have fingerprint clearances, however their clearances were not associated to the facility. This poses an immediate risk to the health, safety, and personal rights to children in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on LPA's observation, the toddler option children were using Room 2 which is licensed for the preschool program. This poses a potential risk to the health, safety or personal rights of children in care.
