Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on observation and record review the licensee did not comply with the section cited above in LPA observed a teacher aide does not have criminal background clearance, which poses an immediate health, safety or personal rights risk to persons in care.

HSC 1596.8662(b)(1) · Type B

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above in 5 out of 5 staff have not completed mandated reporter training, which poses/posed a potential health, safety or personal rights risk to persons in care.

101170(e) Criminal Record Clearance All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: At 9am during inspection LPA observed 2 uncleared indivduasl. This poses an immediate health & safety risk to children in care.

ALLEGATION(S): Child sustained a fractured femur while at the daycare facility INVESTIGATION FINDINGS: Licensing Program Analysts, LPA Yee met with the site director, M.U. to close this complaint. The purpose of the inspection was explained. There are 8 children present today. The Department's Investigation Branch (IB) has investigated this complaint and determined the finding to be unsubstantiated. The reporting party believed the child injured the leg while at daycare. Reporting party was interviewed. Staff members were interviewed. Medical records were obtained. Daycare parents were interviewed and they reported no concerns regarding the care or supervision of children in the infant room. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
