Buildings and Grounds - (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement is not met as evidenced by: Based on the LPA's observations and staff interviews, the sink in Room 4 has been inoperable for approximately one month. This poses a potential risk to the health, safety, and personal rights to children in care.

(d) The surface of the outdoor activity space shall be maintained: (2) Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPA observed that the rubber foam around one of the structures has holes which are considered tripping hazards. This poses a potential health, safety or personal rights risk to persons in care.

ALLEGATION(S): Staff pinched day care child INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Marilou Monico conducted an unannounced complaint investigation. LPA met with Assistant Director, A.C., and Site Director, M.S.J. and explained to them the reason for the inspection. During the course of this investigation, LPA conducted observation, records review, interviewed staff, children, and parents. Based on the information obtained, the above allegation is found to be UNSUBSTANTIATED, meaning although, the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. As a result of this inspection, there were no deficiencies issued. Exit interview conducted and report was reviewed with Assistant Director, A.C., and Site Director, M.S.J. ALLEGATION(S): Daycare child sustained unexplained bruising INVESTIGATION FINDINGS: Licensing Program Analyst (LPA), Marilou Monico, met with Assistant Director, A.C., and conducted a follow-up complaint inspection and to deliver findings. Based on interviews, observations, record reviews, and evidence gathered during the investigation process, it is concluded that although the allegation listed above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. This requirement is not met as evidenced by: Based on assistant director's statement and record review, the licensee did not comply with the section cited above, which poses a potential health, safety or personal rights risk to persons in care.

HSC 1596.8662(b)(1) · Type B

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in 3 out of 7 of the staff (Staff #2, #3, and #5) which poses potential health, safety or personal rights risk to persons in care.

F.F., Equipment and Supplies - The licensee shall maintain the temperature in rooms that children occupy between a minimum of 68 degrees F (20 degrees C) and a maximum of 85 degrees F (30 degrees C). Beverages served by daycare providers to children - Whenever milk is served, serve only lowfat (1 percent) milk or nonfat milk to children two years of age or older. This requirement is not met as evidenced by: Based on Assistant Director's statement and LPAs observation, the licensee did not comply with the section cited above by serving whole milk to children who are 2 years old and 2% milk to children who are 3 years old and up which poses a potential health, safety or personal rights risk to persons in care.

Responsibility for Providing Care and Supervision - (a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: A child (C-1) was found by a staff member (S-2) unattended in Room 7. This poses an immediate risk to the health, safety, and personal rights of children in care. An immediate civil penalty of $500 was assessed.

101223(a)(2) Personal Rights: (a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement is not met as evidenced by: The Facility Staff were not trained in proper handling of children requested immediatly following the first incident by a parent. Training and awareness of staff did not occur until after the second incident. This presents an immediate risk to health and safety of the children in care.
