It is the intent of the Legislature that family day care homes for children should be situated in normal residential surroundings so as to give children the home environment which is conducive to healthy and safe development. It is the public policy of this state to provide children in a family day care home the same home environment as provided in a traditional home setting. The Legislature declares this policy to be of statewide concern with the purpose of occupying the field to the exclusion of municipal zoning, building and fire codes and regulations governing the use or occupancy of family day care homes for children, except as specifically provided for in this chapter, and to prohibit any restrictions relating to the use of single-family residences for family day care homes for children except as provided by this chapter. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above. Licensee is using potty training chairs outside for children's bathroom use which poses/posed a potential health, safety or personal rights risk to persons in care.
(b) The home shall be kept clean and orderly, with heating and ventilation for safety and comfort. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPAs observed the play structures, tables and chairs need to be cleaned and wiped down with spider webs removed which poses/posed a potential health, safety or personal rights risk to persons in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on interview, the licensee did not comply with the section cited above. Licensee and her husband did not have a current completed Mandated Reporter training which poses/posed a potential health, safety or personal rights risk to persons in care.
(c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866. This requirement is not met as evidenced by: Based on interview , the licensee did not comply with the section cited above. LPAs observed licensee did not have a current CPR and First Aid certification which poses/posed a potential health, safety or personal rights risk to persons in care.
(a) Prior to admission to a family day care home, children shall be immunized against diseases as required by the California Code of Regulations, Title 17, beginning with Section 6000. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Child 5 was missing immunization record which poses/posed a potential health, safety or personal rights risk to persons in care.
(d) At the time of acceptance of each child into care, the licensee shall provide the child's parent or authorized representative with a copy of the notice Family Child Care Home Notification of Parent's Rights, LIC 995A (8/06), the Caregiver Background Check Process, LIC 995E (6/05), and the Family child Care Consumer Awareness Information, LIC 9212 (10/05). (1) The licensee shall request the child's parent or authorized representative to sign and date the bottom portion of the notice form LIC 995A (8/06), which acknowledges that the parent or authorized representative has received and read the LIC 995A. The bottom portion of this form must be kept in the child’s file as proof that the parent or authorized representative has been notified of his or her rights and received a copy of the Caregiver background Check Process, LIC 995E (6/05), and the Family Child Care Consumer Awareness Information, LIC 9212 (10/05). This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Child 7 was missing LIC995 which poses/posed a potential health, safety or personal rights risk to persons in care.
(3) A file of affidavits signed by each parent with a child enrolled in the home. The affidavit shall state that the parent has been informed that the family child care home does not carry liability insurance or a bond according to standards established by the state. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above LPAs did not observe LIC282 in children's files which poses/posed a potential health, safety or personal rights risk to persons in care.
Personnel Requirements: The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866. This requirements was not met as evidenced by: The Licensee's CPR and First Aid certifications expired on February 10, 2021. This presents a potential risk to the health/safety of children in care.
