ALLEGATION(S): Lack of supervision resulting in daycare child sustaining injury. INVESTIGATION FINDINGS: On 02/27/2026, Licensing Program Analyst (LPA) Deanna Villagrana met with licensee Giovanna Sivira Gallardo to deliver findings for above allegation. LPA explained the nature of the visit. Present were licensee's mother, son, assistant and seven day care children including four infants. One additional child arrived during visit. Based on observation, interviews conducted and pertinent documentation, although the allegation of lack of supervision resulting in daycare child sustaining injury may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. Any change in household composition including adults moving in or out of the home and anyone living in the home who reaches his or her 18th birthday. This requirement was not met as evidenced by Licensee failed to notify the Department of changes in household. This poses a potential risk Health, Safety Personal Rights risk to children in care.
Evidence of a current tuberculosis clearance, not more than one year prior to or seven days after initial presence in the home, for any adult in the home during the time that children are under care. This requirement was not met as evidenced by Licensee's mother and sister did not have a current tuberculosis test on file. This poses a potential risk Health, Safety Personal Rights risk to children in care.
The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced by Licensee admits she left the home at 9am and returned between 12:30 - 1:00pm. Licensee was away from the home more than 80% of day care hours. This poses a potential risk Health, Safety Personal Rights risk to children in care.
Each family child care home shall have a current roster of children as specified in Health and Safety Code Section 1596.841. This requirement was not met as evidenced by LPA observed three children were missing from children's roster. This poses a potential risk Health, Safety Personal Rights risk to children in care.
