101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Based on interviews, it has been confirmed that staff played the "Fake Police for Kids" video for a child that was misbehaving. This is a potential risk to children in care.
(f) At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in 7 out of 9 staff were missing or did not have current CPR which poses a potential health, safety or personal rights risk to persons in care.
