ALLEGATION(S): 1. Facility staff hit child 2. Facility staff used inappropriate form of punishment 3. Facility staff spoke inappropriately to child INVESTIGATION FINDINGS: On 12/2/25, Licensing Program Analyst(LPA)Anna Morales conducted a subsequent complaint investigation to deliver the findings for the above allegations. LPA was greeted by Director Blanca Hernandez. LPA toured the facility and observed two staff and 16 preschool aged children. During the course of the investigation, LPA Morales interviewed Staff, children and a representative from local law enforcement agency, reviewed supporting documentation, and toured the facility. Staff stated they have never seen any of the staff hit, use inappropriate form of punishment or speak inappropriately to any of the children. Staff stated that they redirect the children to another activity or talk to the children. Children interviewed stated that they have never seen any of the teachers hit nor do they speak to them inappropriately. Children stated that they like coming to school and like all of their teachers. Children stated that if they don't listen to the teachers they will talk to them. Continue on LIC9099C.... Alterations to Existing Buildings or New Facilities(a):Prior to construction or alterations, the licensee shall notify the Department of the proposed change(s). This requirement is not met as evidenced by: LPA observed a fenced playground in the parking lot and children from the Preschool playing and Director stated that she is using the indoor playground as an activity room. Director did not notify the Department of the changes made to the Facility prior to useage.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: S2 and S3 have expired Mandated Reporter Training, which poses/posed a potential health, safety or personal rights risk to persons in care.

(a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above. Director accepted C1, who is younger than two years of age began Preschool on 5/6/2024, which poses/posed a potential health, safety or personal rights risk to persons in care.
Limitations on Capacity:101161(a): A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met by: Through interview and record review, On 4/18/23, the Director enrolled C1(DOB 10/23) who is younger than two years of age. This poses an immediate risk to the health, safety, and personal rights to children in care.
Health-Related Services:101126(a)(2):In the case of less serious injuries including, but not limited to...bites from other children requiring assessment and/or administration of first aid by staff, the licensee shall document the injury in the child's record and notify the child's authorized representative of the nature of the injury when the child is picked up from the center. This requirement was not met as evidence by: On 4/19/2023, staff did not inform the parent of C1 upon pick up, that C1 sustained an minor injury at day care, which posed a potential health, safety or personal rights risk to C1.
(b) All child care centers shall have a director. This requirement is not met as evidenced by: Based on interview and record review, the Child Care Center does not have a qualified Director present.which poses/posed a potential health, safety or personal rights risk to persons in care. Blanca Hernandez stated that she is in the process of obtaining supporting documentation to hire as the new Director.
