101223(a)(3) Personal Rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. ALLEGATION(S): Staff handled day care child in a rough manner. INVESTIGATION FINDINGS: On 11/29/2023 at 10:55AM., Licensing Program Analyst (LPA) Luis J. Gomez met with Director, Angela Tang. Purpose of the inspection was explained and was for an Unannounced, Complaint Investigation. Present was the Director and 3 staff supervising for 31 children. Children present had been signed in. LPA inspected facility indoors and outdoors for health and safety hazards. During today's inspection, LPA performed site observations, interviews, and reviewed facility records. LPA reminded director to ensure children's immunization records are stored in facility files. Advisory Note: Technical Violation (LIC9102TV) was issued. During the course of the investigation observations were conducted on 9/28/2023 and 11/29/2023. A review of the facility records was complete, which included the Staff Records, Children Records, and Parent Handbook. LPA conducted interviews with the Director, Staff, and Children. (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: This requirement is not met as evidenced by: At 10:30AM., Based on record review, interviews and observations, LPA confirmed staff member, S1, present without proper facility association. This poses an immediate health and safety risk to children in care.
Every licensed child day care center shall have one or more carbon monoxide detectors in the facility that meet the standards established in Chapter 8 (commencing with Section 13260) of Part 2 of Division 12. The department shall account for the presence of these detectors during inspections. This requirement is not met as evidenced by: At 9:40AM., Based on observations, LPA confirmed facility's carbon monoxide detector was not in operating condition. (d) Disaster drills shall be conducted at least every six months.
