ALLEGATION(S): Licensee restrained day care children Licensee locked children in a room as a form of discipline Licensee yells at day care children Licensee placed infant in an unsafe environment Licensee placed dangerous chemicals within reach of day care children Licensee operated over capacity INVESTIGATION FINDINGS: On November 6, 2025, at approximately 10:30am, Licensing Program Analyst (LPAs) Maria Olguin-Leon and Leslit Tapia-Mandujano conducted an unannounced complaint investigation to deliver the findings of the above allegation. LPAs met with licensee, Edelmira Cardenas. Present during the inspection was licensee and assistant caring for 7 children (4 infants & 3 preschool age). Facility is operating within capacity of staff/child ratios. All adults present are fingerprint cleared and associated to the facility. During the course of the investigation, LPA conducted interviews and reviewed pertinent information and conducted observations. Based on information gathered the allegation, Licensee restrained day care children, was determined to be SUBSTANTIATED. A type “A” violation was issued today in accordance to the California Code of Regulations, Title 22, Division 12. Please refer to 9099D for more information. Based on information gathered there is not sufficient evidence to prove the allegations: Licensee locked children in a room as a form of discipline, Licensee yells at day care children, Licensee placed infant in an unsafe environment, Licensee placed dangerous chemicals within reach of day care children and Licensee operated over capacity. Although the above allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Licensee, Edelmira Cardenas. (b) Cribs or play yards shall be free from all loose articles and objects. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above as LPAs observed assistant remove bottles of two children who were already inside the crib, and in which one child was already sleeping. This poses an immediate health, safety or personal rights risk to persons in care.
(d) The home shall provide safe toys, play equipment and materials. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above as LPAs observed there are pack and plays/play yard that were soiled and a toy that was broken in outdoor play area, which poses a potential health, safety or personal rights risk to persons in care.
102417 Operation of a Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to: (8) Each family child care home shall have a current roster of children as specified in Health and Safety Code Section 1596.841. This requirement was not met as evidenced by: Based on interviews conducted and record review gathered during complaint investigation, the licensee did not comply with section cited above, as LPA determined the LIC9040-Children’s Roster did not include information of children previously enrolled and no longer attending. LIC9040 states children's roster must be retained for 3 years, which poses a potential health, safety or personal rights risk to persons in care.
102416.1 Personnel Records (c)All personnel records shall be kept for at least three years following termination of employment/volunteer work. This requirement was not met as evidenced by: Based on interviews conducted and record review gathered during complaint investigation, the licensee did not comply with section cited above, as LPA determined personnel records for former staff were not maintained and were not kept for the required three years, which poses a potential health, safety or personal rights risk to persons in care.
102370(d) Criminal Record Clearance (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (1)Obtain a California clearance or a criminal record exemption as required by the Department or This requirement was not met as evidenced by: Based on interviews conducted and record review gathered during complaint investigation, the licensee did not comply with section cited above, as LPA received information and determined there was an unfingerprinted adult working with children in the home, which poses an immediate health, safety or personal rights risk to persons in care.
102416.3 Alterations to Existing Buildings or Grounds (a) Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: (6)Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care. This requirement has not been met as is evident: Based on observation on August 14, 2025, LPA observed cribs and children sleeping in the off limits master bedroom, which poses a potential health and safety hazards to person(s) in care.
102425 Infant Safe Sleep (b) Cribs or play yards shall be free from all loose articles and objects. This requirement has not been met as is evident Based on observation during today's inspection, LPA observed a bottle inside crib next to sleeping infant.
