ALLEGATION(S): Staff hit daycare child INVESTIGATION FINDINGS: Licensing Program Analysts (LPAs), Marilou Monico, and Ashley Lopez, made an unannounced follow-up complaint inspection to interview children and to deliver investigation findings. LPAs met with Site Director, Rashida Naqvi. Based on interviews and record reviews, it is concluded that although the allegation noted on this complaint may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation did or did not occur. The allegation is UNSUBSTANTIATED. There were no deficiencies cited. A Notice of Site Visit was issued and must remain posted for 30 days. Unsubstantiated Estimated Days of Completion:
(e) As a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls. This requirement is not met as evidenced by: Based on LPAs observation, the tanbarks as resilient material under the two slides in the playground are diminishing and need to be replenished which pose a potential health, safety or personal rights risk to persons in care.
(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on LPAs observation, two children used the bathroom at different times without staff supervision which poses a potential health, safety or personal rights risk to persons in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, Staff #1 & #4 have expired Mandated Reporter Training for Child Care Providers which poses a potential health, safety or personal rights risk to persons in care.
(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on record review, Staff #3 is missing immunizations in measles, pertussis and flu which poses a potential health, safety or personal rights risk to persons in care.
(a) Prior to, or within 30 calendar days following the enrollment of a child, the licensee shall obtain a written medical assessment of the child. This medical assessment enables the licensee to assess whether the center can provide necessary health-related services to the child. This requirement is not met as evidenced by: Based on record review, Child #2, #5 and #6 are missing physician's report and TB test which poses a potential health, safety or personal rights risk to persons in care.
(b) The person who brings the child to, and removes the child from, the center shall sign the child in/out. This requirement is not met as evidenced by: Based on record review, two children were not signed in for today which poses a potential health, safety or personal rights risk to persons in care.

(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (2) Request a transfer of a criminal record clearance as specified in Section 101170(f) or This requirement is not met as evidenced by: Based on record review, Staff #4 has been working at the facility without fingerprint clearance associated at this site. This poses a potential risk to the health, safety or personal rights to children in care. Civil penalty of $100 was assessed.
(1) Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement is not met as evidenced by: Based on record review, Staff #1 is missing health screening report in the file. This poses a potential risk to the health, safety or personal rights to children in care.
(g) A photocopy of the teacher's Child Development Permit as specified in (c)(3) above, or a photocopy of the teacher's transcript(s) documenting successful completion of required course work, shall be maintained at the center. This requirement is not met as evidenced by: Based on records review, Staff #1 is missing teacher's transcripts in the file. This poses a potential risk to the health, safety or personal rights to children in care.
(g) The licensee shall document each child's immunizations and shall maintain such documentation in the center for as long as the child is enrolled. This requirement is not met as evidenced by: Based on records review, Child #3 & #4 are missing immunization records. This poses a potential risk to the health, safety or personal rights to children in care.
