ALLEGATION(S): Staff did not provide adequate supervision to children in care INVESTIGATION FINDINGS: On August 20, 2026, Licensing Program Analysts (LPAs) Marilou Monico and Dongzhu Li conducted a follow up Complaint Inspection. LPAs met with Assistant Director, L.N., and informed her regarding the purpose of today's visit. LPAs toured the facility. During the course of the investigation, LPA Monico interviewed staff, children, and parents; reviewed records; conducted observations; and obtained supporting documents. Interviews with staff, children, and parents confirmed that children were never left without staff supervision. Staff were observed scattered in different areas indoor and outdoor to ensure adequate supervision is provided to children. Staff intervened immediately when a child attempted to harm another child. Parents were notified of incidents by phone and through the Learning Genie app, and they were provided with an ouch report at pick-up when their child sustained an injury at the center. Every licensed child day care center shall have one or more carbon monoxide detectors in the facility that meet the standards established in Chapter 8 (commencing with Section 13260) of Part 2 of Division 12. The department shall account for the presence of these detectors during inspections. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. LPA and LPM observed that the facility does not have a functioning carbon monoxide detector.

(1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: On February 20, 2026, a child (C2) was unattended outside the front door of Room 15. This poses an immediate risk to the health, safety, and personal rights to persons in care.

ALLEGATION(S): Staff did not dress child appropriately for the weather INVESTIGATION FINDINGS: On March 5, 2026, Licensing Program Analyst (LPA) Marilou Monico met with Site Director, T.H., for an unannounced complaint inspection and to deliver investigation findings. LPA toured the indoor and outdoor areas of the facility and census was taken. Based on interviews, on 02/19/26, a child wet their pants and underwear while playing outdoors. Staff checked the child's cubby and found that the child had no additional pants available. Staff immediately notified the parents and requested that they bring extra pants to the center. Because the child did not have spare pants and the classroom did not have backup pants available, staff provided the child with center's backup shorts. The shorts extended below the child's knees. This requirement was not met as evidenced by: On 10/15/25, Staff (S1) found a child (C1) alone in an area between Room 35 and staff lounge building. This requirement was not met as evidenced by: On 04/23/25, a child (C1) was left unsupervised by staff in Room 26. On 04/24/25, a child (C2) was unattended in Room 35. This poses an immediate risk to the health, safety, and personal rights to persons in care.

CCR 101238.2(d)(2) · Type B

(d) The surface of the outdoor activity space shall be maintained: (2) Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. This requirement is not met as evidenced by: Based on LPA's observation, the rubber foam on the two's yard has a hole which poses a potential health, safety or personal rights risk to persons in care.

HSC 1596.8662(b)(1) · Type B

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, Staff #7 has no Mandated Reporter Training certificate on file and Staff #9's certificate is expired which poses a potential health, safety or personal rights risk to persons in care.

CCR 101226(e)(3)(A) · Type B

(3) Prescription medications may be administered if all of the following conditions are met: (A) Prescription medications shall be administered in accordance with the label directions as prescribed by the child's physician. This requirement is not met as evidenced by: Based on LPA's observation, three children have expired prescription medication which poses a potential health, safety or personal rights risk to persons in care.

(1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: On 09/27/24, a child (C1) was left outside unsupervised on the classroom's enclosed patio. This posed an immediate risk to the health, safety, and personal rights to persons in care.

CCR 101223(a)(3) · Type A

Personal Rights - The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: A teacher (S-1) was witnessed speaking harshly to a preschool child, pushing the same child and withholding food to the child on the morning of 08/05/24. This poses an immediate risk to the health, safety, and personal rights of children in care.

This requirement was not met as evidenced by: A staff member (S-1) found a daycare child (C-1) in the bathroom under the supervision of a practicum student. This poses a potential risk to the health, safety, and personal rights to persons in care.

Reporting Requirements - Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1), a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not met as evidenced by: The Director failed to report an alleged incident to Community Care Licensing (CCL) within the required time frame. This poses a potential risk to the health, safety, and personal rights of children in care.

HSC 1596.8662(b)(1) · Type B
