ALLEGATION(S): Licensee does not provide clean bedding for children in care. Licensee is serving expired food to children in care. INVESTIGATION FINDINGS: Licensing Program Analyst (LPA), Oscar Huang, conducted an unannounced subsequent complaining visit to the Facility today. LPA Huang met with Licensee, Chi Mei Wang and explained the nature of today's visit to her. Based on interviewed with staff, and LPA's own observations, the allegations listed above could not be proved or disproved. LPA concludes that although the allegations may have happened or are valid, there were not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED. No deficiency was cited. The investigation report was discussed and verbally translated into Chinese during the exit interview with Licensee, Chi Mei Wang. (d) All personnel records shall be maintained at the child care home and shall be available to the licensing agency for review. (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in cleaning compounds in the bathroom under sink which poses/posed a potential health, safety or personal rights risk to persons in care.
(b) The licensee shall post the PUB 394 (8/02), Family Child Care Home Notification of Parents’ Rights Poster in a prominent, publicly accessible area in the family child care home at all times children are in care. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in not posting PUB 394 (8/02) form which poses/posed a potential health, safety or personal rights risk to persons in care.
Criminal Record Clearance - All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (2) Request a transfer of a criminal record clearance as specified in Section 102370(j) This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above for not requesting transfer of a criminal record of one helper prior to work which posed an potential health, safety or personal rights risk to persons in care.
