ALLEGATION(S): Licensee and a adult hit the daycare children while in care. Licensee is demonstrating inappropriate forms of discipline. Licensee does not provide adequate care and supervision of the daycare children. Adults pose as a risk to the daycare children while in care. INVESTIGATION FINDINGS: On April 17, 2025, Licensing Program Analyst (LPA) Zeynep Basak and Licensing Program Manager (LPM) Daniel Oquendo conducted an unannounced visit to the facility to conclude the complaint received on March 12, 2025. Upon arrival, LPA and LPM met with the licensee, Carrie Russell, and explained the purpose of the visit. During today’s visit, LPA observed 3 adults and 3 children (2 infants and 1 preschooler) present. LPA verified that all present adults had cleared background checks through the Guardian website. As part of the complaint investigation conducted on March 18, 2025; April 7, 2025; and April 15, 2025, LPA obtained pertinent documentation, reviewed facility records, and conducted interviews with children, parents, and staff members. Based on the investigation and the information obtained, the above allegations were determined to be unsubstantiated. Therefore, the complaint is considered closed. The report was reviewed and signed by the licensee, Carrie Russell. The findings were provided during the visit. ALLEGATION(S): Licensee caused injuries to child in care Licensee hit child in care Licensee pushed child in care Licensee forced child in care to nap INVESTIGATION FINDINGS: On October 12, 2023, Licensing Program Analyst (LPA), Garcia conducted an unannounced conclusionary complaint visit and met with licensee, Carrie Russell to discuss the above allegations. Purpose of the inspection was explained. Present are, 2 helpers with the licensee taking care of 5 children. During the course of the investigation, interviews were conducted with staff members and relevant documents were gathered. Based on the interviews and relevant documents, there was no sufficient evidence to prove that the allegations listed above, occured. Although the allegations may have happened or is valid, there is no preponderance of evidence to prove the alleged violation did or did not occur. Therefore, the allegations are UNSUBSTANTIATED. LPA conducted exit interview with Licensee, Carrie Russell. Report and Notice of Site Visit was provided. Notice of Site Visit shall be posted for 30 consecutive days. ALLEGATION(S): Licensee did not prevent inappropriate behaviors between day care children INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Marie Rodriguez conducted an unannounced inspection to close a complaint and deliver a finding. LPA met with Licensee Carrie Russell and explained purpose of visit. Present in the home were the Licensee, Licensee's husband, Licensee's adult son, and seven children. Licensee's helper arrived a short time later. During the course of the investigation, LPA conducted interviews and reviewed pertinent documentation. Although the allegation the Licensee did not prevent inappropriate behaviors between day care children may have happened or may be vaild, based on the information gathered, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is found to be UNSUBSTANTIATED. ALLEGATION(S): Adult in the home poses a risk to daycare children while in care. INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Marie Rodriguez conducted a subsequent unannounced complaint inspection to discuss the above allegation with Licensee Carrie Russell. Present in the home were the Licensee, her husband, her adult son, and 8 children. Allegation was investigated by the Department’s Investigations Branch (IB). During the course of the investigation, IB Investigator Eddie Phung conducted interviews with Licensee, Licensee’s family, children’s guardians, and other relevant parties and obtained relevant documentation. Although the allegation that an adult in the home poses a risk to daycare children while in care may have happened or may be vaild, based on the information obtained by IB Investigator Phung, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is found to be UNSUBSTANTIATED. Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.
(d) All personnel records shall be maintained at the child care home and shall be available to the licensing agency for review. This requirement is not met as evidenced by: Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above in [count] out of [total count] [(objects) (persons)] [identifiers] which poses/posed a potential health, safety or personal rights risk to persons in care.
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in two items left out in daycare areas, detergent and a power tool, which posed a potential health, safety or personal rights risk to persons in care.
