CCR 101223(a)(3) · Type A

101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to.... The requirement was not met as evidenced by: based on interviews, a photograph, and video footage, it was determined that on 02/03/2026, between approximately 11:20 a.m. and 11:23 a.m., one teacher (S1) roughly grabbed child (C1)’s arms for about two minutes, causing red marks under the child’s left armpit, which posed an immediate risk to the health and safety of the children in care.

The requirement was not met as evidenced by: based on information obtained from interviews and video footage, on 10/20/2025, between approximately 4:00 p.m. and 4:30 p.m., one teacher (S1) pulled a child’s (C1) hair, then C1 rubbed his head and walked away and one parent (P1) observed the entire incident, which posed an immediate risk to the health and safety of the children in care.

CCR 101223(a)(2) · Type A

Personal Rights - (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: on 01/28/25, a parent (P1) of a preschool child was allowed to pick up child (C1) from the facility even though there was a protective order. This posed an immediate risk to the health, safety and personal rights to children in care.

CCR 101229(a)(1) · Type B

Responsibility for providing care and supervision: The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: one preschool child proceeded to run to the entry/exit gate from the outdoor preschool playground to meet the child's father when the father arrived to pick up the child on April 26, 2022.

ALLEGATION(S): Staff discriminated against day care child INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Mel Matos conducted an unannounced follow up complaint investigation and met with Jenifer Ta, director. Purpose of today's follow up complaint investigation: deliver investigation findings. The investigation of the complaint allegation listed in this complaint was conducted by LPA Mel Matos. Based on the available evidence, including observations of the Facility, and interviews completed for the complaint investigation, it is concluded that although the allegation noted on this complaint may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. The allegation is thus UNSUBSTANTIATED. A NOTICE OF SITE VISIT WAS ISSUED, POSTED NEAR THE ENTRANCE TO THE FACILITY, AND MUST REMAIN POSTED FOR 30 DAYS. Unsubstantiated Estimated Days of Completion:
