ALLEGATION(S): - Staff allowed children to eat from the floor INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Marie Rodriguez conducted an unannounced inspection to open a complaint. LPA met with Teacher S.B. and explained purpose of inspection. Executive Director J.M. and Director S.N. arrived a short time later. Present at the school were the directors, 6 teachers, and 34 preschool aged children. During the course of the investigation, LPA conducted a physical plant tour of the facility and conducted interviews. LPA observed the school to be clean and in good repair. LPA observed the multi-purpose room and the rugs in the room to be clean. Multi-purpose room is only used for napping and music and dance classes. Children eat their meals in a separate room. Per the Executive Director and Director, the school is cleaned throughout the day by staff and a cleaning crew deep cleans the school on Friday evenings. Children do not eat in the multi-purpose room and are never allowed to eat food that is dropped or put on the floor. Children are only in the meal room adjacent to the kitchen during meals and snack time and are always supervised. Per the Executive Director and Director, the school is cleaned throughout the day by staff and a cleaning crew deep cleans the school on Friday evenings. Based on the information gathered, there is insufficient evidence to prove staff do not provide adequate supervision to children, staff left a stove unattended while children were present, and staff do not properly maintain the facility. ALLEGATION(S): - Child in care sustained fracture due to lack of supervision INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Marie Rodriguez conducted an unannounced subsequent visit to close a complaint. Executive Director J.M. and Director S.N. arrived a short time later. Present at the school were the directors, 6 teachers, and 34 preschool aged children. During the course of the investigation, LPA conducted a physical plant tour of the facility, conducted interviews, and reviewed records. LPA observed appropriate staff to child ratio at all times while indoors and outdoors. LPA observed a teacher positioned near the play structure while children are in the outdoor play area. Per interviews conducted, Child C1 was redirected on numerous occasions not to jump off the slide and still did so even with appropriate staff supervising children. Based on the information gathered, there is insufficient evidence to prove a child sustained a fracture due to lack of supervision. ALLEGATION(S): Day care children are being yelled at while in care. Day care children are being spoken to inappropriately while in care. Day care children have access to sharp objects while in care. Facility is dirty. Facility is odiferous. INVESTIGATION FINDINGS: On August 1, 2022 at approximately 9:10am, Licensing Program Analyst (LPA) Catrina Quimbo conducted a complaint visit to Building Kidz (PS) regarding above allegations. LPA met with executive director, J.M., and explained the purpose of the visit. Facility is a combination center with separate preschool and infant licenses. Under the preschool license, present during the visit included 37 children and 12 staff members. With executive director, LPA toured entire facility for health and safety hazards. Preschool program includes 4 classrooms currently in operation, multi-purpose area, lunch room, and outdoor area. As part of this complaint investigation, LPA obtained documents that included preschool program's enrollment packet, preschool program's parent handbook, and employee handbook. 101212(d)(1)(C) Reporting Requirements. Any unusual incident or child absence that threatens the physical or emotional health or safety of a child shall be reported to the Department within 24 hours of the occurrence. This requirement is not met as evidenced by: Based on observation, interview, and record review, the facility did not ensure to submit unusual incident reports regarding biting incidents that occurred from 05/03/2021 through 06/11/2021. This poses a potential safety risk to children in care.

101223(a)(1) Personal Rights. (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement is not met as evidenced by: Based on the observation, interview, and record review, LPA confirmed that from 05/03/201 through 06/11/2021, a child(C1) was bitten by another child(C2) several times, while in care which violated the child's personal rights. This poses potential health and safety risk to the children in care.
