101223 Personal Rights (a)(3) The licensee shall ensure that each child is according the following personal rights…To be free from corporal or unusual punishment… This requirement was not met as evidenced by: Based on interviews and record reviews, a staff member was observed to grab a child, pick the child up and force the child to sit down in a rough, inappropriate manner. This poses an immediate health, safety or personal rights risk to children in care.
ALLEGATION(S): Staff member inappropriately handled a child in care. INVESTIGATION FINDINGS: On January 13, 2026 at approximately 9:50am, Licensing Program Analysts (LPAs) Quimbo and Olguin-Leon conducted an unannounced, complaint visit. LPAs met with director, Jessica Smith, and explained the purpose of the visit. Facility is a multi-component facility licensed for an infant, toddler and preschool programs. Present during LPAs’ visit included 50 children and 11 teaching staff (including director and 1 substitute). LPAs observed 8 infant children with 2 teaching staff (in Caterpillars room), 11 toddler children with 3 teaching staff (in Ladybugs room) and 31 preschool children with 5 teaching staff (15 children with 3 staff in Honeybees room and 16 children with 2 staff in Dragonflies room). During today’s visit, LPAs interviewed 8 teaching staff, and obtained and reviewed facility records. LPAs requested to review camera footage of self reported incident. This requirement was not met as evidenced by: Based on observation, interview and record review, 18 preschool children were present in the Honeybees classrooms with 2 staff (including TA1). LPAs observed TA1 does not have Early Childhood Education units, therefore teacher to child ratio was not met. This poses a potential health, safety or personal rights risk to children in care. 1596.8595(c)(2) ) Upon enrollment of a new child in a facility, the licensee shall provide to the parents or legal guardians of the newly enrolling child copies of any licensing report that the licensee has received during the prior 12-month period that documents any Type A citation....This requirement was not met as evidenced by: Based on interview and record review, LPAs observed 5 children's records to be missing a signed Acknoweldgement of Receipt of Licensing Reports (LIC9224), which poses a potential health, safety or personal rights risk to children in care.
101216.3: Teacher-Child Ratio: (a) "There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance" This requirement was not met as evidenced by: Based on observation and record review of video footage, there were instances where the preschool classrooms were more than 12 children with one teacher present by stepping out of the classroom, which poses a potential health, safety or personal rights risk to persons in care.
