ALLEGATION(S): One (1) Personal Rights allegation: Staff do not prevent a daycare child from biting another daycare child while in care INVESTIGATION FINDINGS: On 07/30/2025 at 1:30pm, Licensing Program Analyst (LPA) Jialing “Julianne” Zhu conducted an UNANNOUNCED COMPLAINT SITE INSPECTION. LPA met with Director Cynthia “Cindy” Alvarez. LPA advised director the nature of the inspection is to deliver the findings of the complaint investigation. Present during the inspection were five (5) fingerprint-cleared staff and 30 (3 toddlers and 27 preschool-age) children. This agency has investigated the complaint alleging staff do not prevent a daycare child from biting another daycare child while in care. Throughout the course of the inspection, LPA conducted interviews with Licensee/Owner Dibjot Gill, Director Cindy Alvarez, staff (teachers & assistants), and a sampling of children. LPA reviewed a sample of staff and children’s files. LPA also made observations of interactions between facility staff and children when inside and outside. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. Report was reviewed, exit interview was conducted, and Appeal Rights were provided to Director Cindy Alvarez. Notice of Site Visit was given and must remain posted for 30 days. 101216.4 Preschool Program with Toddler Component (a)(2) The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department. This requirement is not met as evidenced by: Based on LPA observation and interview, the licensee did not comply with the section cited above as LPA observed toddlers eating snacks and sleeping in the same area with preschool-age children, which poses/posed a potential health, safety or personal rights risk to persons in care.
Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on LPA observations, interview, and record review, the licensee did not comply with the section cited above as 1 of 7 staff (volunteer) present at the facility during the inspection did not have a fingerprint clearance associated to the facility and was providing care and supervision to the children, which poses an immediate health, safety or personal rights risk to persons in care.
(a) The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as 2 of 7 staff present at the facility did not have a completed file readily available for LPA to review during the inspection, which poses/posed a potential health, safety or personal rights risk to persons in care.
(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above as the facility is operating over-ratio as there are not enough teachers and fully-qualified teachers, which poses/posed a potential health, safety or personal rights risk to persons in care.
Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. 101419.2 Infant Needs and Services Plan (a) Prior to the infant's first day at the center, the infant care center director or assistant director shall complete a needs and services plan for the infant. This requirement is not met as evidenced by: Based on interview and record review, the Director did not comply with the section cited above as Infant Needs and Services plans are not kept for any enrolled infants (0-24 months of age), which poses/posed a potential health, safety or personal rights risk to persons in care.
