To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by LPA received two statements from assistant director and one teacher (S2) stating (S3) engaged in a verbal altercation with S2 and S4 on the toddler playground in front of children on 05/04/2026. The altercation included inappropriate comments about relationship with the parents. A termination letter was also received stating S3 engaged in unprofessional and inappropriate behavior during a workplace incident in the presence of children and staff, which did not align with expected professional standards. This poses a potential risk Health, Safety Personal Rights risk to children in care.

CCR 101227(a)(1) · Type B

(a) In child care centers providing meals to children, the following shall apply: (1) All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner. This requirement is not met as evidenced by: Based on observation, interview, record review, the licensee did not comply with the section cited above. LPA observed the food menu is not being followed. Menu stated today, 03/02/2026 brocoli and fruit will be served. LPA observed mixed vegetable and no fruit being served. Not until LPA addressed the issue, Director H.N. went to the kitchen to get cuties for the classrooms which poses/posed a potential health, safety or personal rights risk to persons in care.

CCR 101227(a)(6) · Type B

Menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request. This requirement was not met as evidenced by LPA observed facility is not providing the quantity necessary meeting the needs of the children. The facility did not provide fruit during lunch time in the month of February. On 02/02/2026 and 02/12/2026, the facility did not provide a fruit and/or vegetable as required. This poses a potential risk Health, Safety Personal Rights risk to children in care.

Criminal Record Clearance: (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(1)Obtain a California clearance or a criminal record exemption as required by the Department... This requirement was not met as evidenced by: Based on records review and interviews, Licensee allowed a staff(S1)to work at the facility without criminal record clearances since 01/22/2025, which poses a potential risk to the health, safety, and personal rights of children in care.

Purpose of today's investigation: deliver investigation findings. LPA conducted observations, interviewed staff, reviewed records, reviewed staff files and gathered evidence during the investigation. LPA toured inside areas of the facility during investigation. During today's investigation, LPA reviewed the video clip of classroom D2, of 04/24/2025, where staff (S1 and S2) were present with children during nap time in classroom D2, with Licensee Representative and Director.
