101223(a)(2) Personal Rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. Based on information collected, LPA confirmed, this requirement has not been met, Day care child was bitten by other day care child while in care due to inadequate staff supervision, poses a potential health, safety or personal rights risk to persons in care.
ALLEGATION(S): Staff did not address inappropriate interactions between day care children in care. Staff do not ensure that day care child is fed a sufficient amount of food while in care. INVESTIGATION FINDINGS: On November 3, 2023, Licensing Program Analyst (LPA) Maria Olguin-Leon conducted an unannounced, complaint investigation and met with Director, Eman Isbeih, regarding above allegations and explained the purpose of the visit. LPA and Director toured facility for health and safety hazards. Present during today’s visit were Director, 5 staff and 12 infants. All staff working at facility have fingerprint clearance and are associated. During the course of the investigation, interviews were conducted with Director, staff, parents, involved parties, and relevant documents were gathered. LPA did not observe any of the above allegations and was unable to validate allegations. Although the allegations above may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED LPA conducted exit interview with Director, Eman Isbeih.
