The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced by licensee was out of state starting 10/08/2024 and returned on 10/14/2024 leaving her assistants alone with children during day care hours. This poses a potential risk Health, Safety Personal Rights risk to children in care.
1596.8669(b) Additional health and safety training; condition of licensure Day care center directors and licensees of family day care homes shall ensure that at least one staff member who has a current course completion card in pediatric first aid and pediatric CPR...shall be onsite at all times when children are present at the facility... This requirement was not met as evidenced by: Based on interviews and record reviews, licensee was unable to provide current CPR and first aid training for their spouse who was left alone with a child in care. This poses a potential risk t the health and safety of the childrne in care.
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPA observed several sharp yard tools and charcoal for BBQing accessible to children in the backyard which poses an immediate health, safety or personal rights risk to persons in care.
Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision(f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. A1 was fingerprint cleared but never associated to the license which poses an immediate health, safety or personal rights risk to persons in care.
(e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. Present were licensee and seven day care children including three infants. Licensee was out of ratio which poses an immediate health, safety or personal rights risk to persons in care.
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPA observed the emergency exit on the right side of the home was obstructed by two BBQ pits, a bike, ladders, a bench, several large buckets, yard tools and garbage cans which poses/posed a potential health, safety or personal rights risk to persons in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above. Licensee completed Mandated Reporter training on 10/29/2023 which poses/posed a potential health, safety or personal rights risk to persons in care.
(a) The licensee shall maintain, in each child's record, the signed and dated notice form required in Section 102419(d). This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Child 4 is missing LIC995 which poses/posed a potential health, safety or personal rights risk to persons in care.
Documentation shall be maintained in the infant’s file and be available to the Department for review. LPA did not observe a Safe Sleep log for all infants in care which poses/posed a potential health, safety or personal rights risk to persons in care.
This requirement includes updating each child's PM 286 (6/95) when the child is due to receive required immunizations after enrollment in the family day care home. This requirement was not met as evidenced by Child 1 and 3 immunization records need to be updated. This poses a potential risk Health, Safety Personal Rights risk to children in care.
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above in, aerosol can of Lysol, Clorox spray bottle, liquid Cleaner degreaser in accessible unlocked kitchen sink cabinet and hand soap in unlocked on limit bathroom cabinet which poses an immediate health, safety or personal rights risk to persons in care.
(b) For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be one of the following: (2) Six children, no more than three of whom may be infants; or This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above, Licensee was alone with 4 infants and 8 preschool age children until 9:52 AM when assistant A1 arrived to assist which poses an immediate health, safety or personal rights risk to persons in care.
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (1) Fireplaces and open face heaters shall be screened to prevent access by children. The home shall contain a fire extinguisher and smoke detector device which meet standards established by the State Fire Marshall. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above in fire extinguisher was purchased on 07/05/21 and has not been serviced, which poses/posed a potential health, safety or personal rights risk to persons in care.
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. As their age and ability permit, newly enrolled children shall be informed promptly of their duties as required in the plan. (A) Each family child care home shall conduct fire drills and disaster drills at least once every six months. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above in Provider did not have documentation of conducting fire and disaster drills every 6 months, which poses/posed a potential health, safety or personal rights risk to persons in care.
(a) There shall be one crib or play yard for each infant who is unable to climb out of the crib or play yard. (3) Mattresses shall be firm and covered with a fitted sheet that is appropriate to the mattress size, fits tightly on the mattress, and overlaps the underside of the mattress so it cannot be dislodged. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above, fitted sheets were not being utilized on mattress with sleeping infant C3, which poses/posed a potential health, safety or personal rights risk to persons in care.
No infant shall be forced to sleep, to stay awake, or to stay in the designated sleeping area. This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above in infant C1, was left in infant room crying with door almost fully closed, which poses/posed a potential health, safety or personal rights risk to persons in care.
(8) Each family child care home shall have a current roster of children as specified in Health and Safety Code Section 1596.841. This requirement is not met as evidenced by: Based on observation, interview, record review, the licensee did not comply with the section cited above in Child C3 missing from current roster, which poses/posed a potential health, safety or personal rights risk to persons in care.

(1) Four infants; or (2) Six children, no more than three of whom may be infants; or (3) More than six and up to eight children, without an additional adult attendant... This requirement was not met as evidence by: Based on record review and observation: Present were licensee and their assistant Diana with 6 children in care: 5 infants and 1 preschool. This poses an immediate risk to the health and safety of the children in care.
